130 <br /> <br />TUESDAY, APRIL 9, 1996 <br /> <br />development programs in a manner to affirmatively further the purposes <br />of the fair housing laws; and <br /> <br />WHEREAS, the basis for discrimination outlawed by the federal and state <br />fair housing acts are race, color, sex, religion, national origin, <br />handicap, age and familial status; and <br /> <br />WHEREAS, the City of Martinsville believes fair housing choice means <br />the ability of persons of similar income levels to have available to <br />them a like range of housing choices and will promote understanding of <br />equality and freedom of choice to achieve acceptance and attainment of <br />the goals embodied in the fair housing laws; and <br /> <br />WHEREAS, the City has certified it will take actions in implementing <br />its housing and community development activities through the Virginia <br />Small Cities Community Development Block Grant Program in a manner to <br />affirmatively further fair housing in the private and public sectors; <br />now, therefore, <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in <br />regular session assembled April 9, 1996, that it does hereby pledge to <br />work with its citizens in pursuit of the shared goal and responsibility <br />for providing equal housing opportunities for all and to maintain an <br />unwavering belief in the principles of Equal Housing Opportunity. <br /> <br />Council considered adoption of Ordinance No. 96-4 amending the Noise <br />Ordinance of the City Code. Mr. Reynolds noted that Commonwealth's <br />Attorney J. Randolph Smith, Jr. had developed the Ordinance in response <br />to concerns expressed by citizens during the March 26, 1996 Town <br />Meeting. Upon motion, duly seconded and by unanimous vote, Council <br />adopted the following Ordinance on an emergency basis: <br /> <br />Sec. 13-11. Excessive, unnecessary, etc., noise <br /> <br />(a) It shall be unlawful and a Class 1 misdemeanor for any person: <br /> <br /> (6) To emit, from any loudspeaker or sound amplification equipment <br />located in or on any open or closed vehicle, trailer, airplane, or <br />balloon, or boat any advertisement, or commercial message, music, <br />speech, or noise which can be heard by the unaided human ear at a <br />distance greater than three feet away from outsidc of such vehicle, <br />trailer, airplane, or balloon orb oat by thc unaidcd human car in any <br />district in thc city. <br /> <br /> (7) To cmit, from any loudspcakcr or sound amplification cquipment <br />locatcd in or on any vchiclc, trailcr, airplanc, balloon or boat, any <br /> <br /> <br />
