TUESDAY, MAY 26, 1998 <br /> <br />Item 0i.) Council unanimously approved an Ordinance to amend the Restrictive Covenants for property at <br /> <br />the Martinsville Industrial Park, changing the land/b. uilding ratio requirement from 3.0:1 to 2.5: 1, said change <br />to become effective only if approved by all other landowners in the industrial park. This Ordinance reads as <br />follows: <br /> <br /> ORDINANCE <br /> <br /> WHEREAS, at least two owners of land in the Martinsville Industrial Park have requested a <br />variance from its Restrictive Covenants requiting a building to land ratio of no more than 1 to 3 on behalf of an <br /> <br />owner offand in said Industrial Park, and .', <br /> <br /> WHEREAS, every other owner of land in said Industrial Park has to consent tb such a variance in <br />order for it to be effective, and <br /> <br /> WHEREAS, it is anticipated that additional requests for other variances will be forthcoming, and <br />that the simplest and most effective way to achieve this is to amend the aforesaid restrictive covenants so as to <br />require a building to land ratio of 1 to 2.5 that shall apply to everyone and thereby obviate the need for individual <br /> <br />variances, and <br /> <br /> WHEREAS, the action needed to do this would be the enactment of an ordinance by Martinsville <br />City Council amending the aforesaid restrictive covenants to provide for a building to land ratio of 1 to 2.5, which <br />ordinance may not become effective until the amendment enacted therein is approved by all the other owners of <br />land in said Industrial Park, <br /> <br /> NOW THEREFORE, be it ORDAINED by the Council of the City of Martinsville, Virginia in <br />regular session held on May 26, 1998, that the Restrictive Covenants of the Mar~nsville Industrial Park be, and they <br />hereby are, amended so that the building to land ratio set forth therein be, and it hereby is, changed from 1 to 3 to 1 <br /> <br />to 2.5. <br /> <br /> <br />
