He went on to state that there must be a cooperation <br />agreement drafted between the City and the Town, but that this would not be used unless a taking of property had <br />to occur. He emphasized strongly, however, that there was no anticipation of the need for such a taking, and that <br />in the event such a thing had to be done it would only occur if the Town Council of Stuart requested such an <br />action by Resolution, on their behalf. Mr. Poore also noted that the Authority must first approve the developmev"" <br />plan for the work. Upon a question from Mrs. Haskell, Mr. Poore confirmed that assistance grated under the <br />action requested tonight would only constitute general agreement to have the City Housing Authority assist the <br />Town of Stuart, and that the details of the project plan would be formulated and sent to them later. Council <br />Member Haskell asked whether there was any financial or legal liability for the City in this matter, and Mr. Poore <br />responded that there was absolutely no financial liability, and that the only legal liability might be that which would <br />occur if a taking of land became necessary, which would only occur at the request of the Town Council of Stuart. <br />City Attorney David Worthy noted that there were provisions in the agreement for the Town of Smart to fully <br />indemnify the City, and that the City would have the protection of sovereign immunity in this matter as well. <br /> <br />Council Member Teague observed that this was an excellent opportunity for the two jurisdictions to work together <br />for the common good, and Vice-Mayor agreed, saying the City should do all it could to help out. Ms. Haskell <br />stated that such an investment should render significant improvement results. The Mayor asked when the work <br />would be done and was told that it would occur within the next twelve months. Upon motion duly seconded, and <br />by unanimous vote the Martinsville Redevelopment and Housing Authority agreed to assist the Town of Smart in <br />its application for and implementation of a Community Development Block Grant for Redevelopment of <br /> <br />Downtown Smart. The MRHA then adjourned and reconvened as the City Council. <br /> <br />Council next considered authorization of Phase II of the Rives Road Industrial Park demolition project. Mr. <br />Tom Harned, Assistant to the City Manager for Development, came fortyard to discuss the progress of the <br />Rives Road Industrial Park demolition project, and ask for authorization to move ahead on the second and <br /> <br /> <br />
