STATEMENT <br /> <br />I am very happy to be here tonight, as an individual citizen, and as a member of a <br />group of citizens resolved to affect the most positive of agendas - that of supporting <br />our City Council, the hard-working officials involved in City Administration, and <br />the betterment of our community, our lives, and our future. <br /> <br />My portion of the group presentation has been prepared in the form of a <br />memorandum, to ensure that the rather technical points of our presentation tonight <br />are made a verbatim part of the record of this public hearing. <br /> <br />Many others will request time to speak tonight on other issues not directly <br />addressed by this written document. <br /> <br />In consideration of constraints on your time, we request that Council accept this <br />entire document as a part of the record of this matter. I will then read the following <br />Summary into evidence. <br /> <br />ff deemed necessary, I can read the entire document into evidence. <br /> <br />SUMMARY <br /> <br />PROTEST: <br /> <br />This is filed with the City Council in conformity with the City Charter, to promote <br />our objection to the purported "Extension" of the Special Use Permit for Royal Oak <br />Townhouses. <br /> <br />VIOLATIONS OF THE SPECIAL USE PERMIT REPORTED: <br /> <br />I will briefly summarize the main points of the five violations found in the <br />document. We chose these violations as a representative sample to support our <br />position that the Developer has fared to devdop the subject property as he said he <br />would, and has failed to comply with the provisions of the Special Use Permit. <br /> <br />Violation # 1 - <br />The Developer failed to comply with the Special Use Permit requirement that <br />construction comply with all zoning ordinance requirements applicable to the R-9 <br />residential district. This is a continuing, unresolved violation of the Special Use <br />Permit. <br />Specifically, the Devdoper built the townhouses too dose to the rear of the lot. <br />Rear Setback lines for Lots 7 and 8 violate the R-9 residential district requirements. <br />This impairs the ability of the owners of these lots to sell or refinance them. <br />Accurate surveys of other lots in the development may reveal other like violations. <br /> <br /> <br />
