TUESDAY, NOVEMBER 12, 1996

Council considered adoption, on emergency basis, of Ordinance No. 96-12
amending Chapter 18--Solid Waste of the City Code and authorizing the
City Manager to execute a Memorandum of Understanding with the West
Piedmont Planning District Commission for participation in the Waste
Tire Fund Program through the Virginia Department of Environmental
Quality to provide a Waste Tire Collection and Processing Center. Leon
E. Towarnicki, Director of Public Works, and Jeff Joyce, Landfill
Manager, were present to explain the purpose of the Waste Tire Fund
Program is to provide a convenient and economical method of removing
waste tires from landfills. Under the Program, tires will be processed
and recycled by a private processor contracted with the State. The
Program is administered by the Central Virginia Planning District
Commission in conjunction with the West Piedmont PDC. The State has
allocated $17,863 for the City and $62,942 for Henry County to operate
the program for a two-year period. The proposed Ordinance was said to
be necessary because the State recommends a tipping fee of $1.00 for
tires, whereas the current City Code mandates a $2.00 fee. In response
to a question from Council, Mr. Towarnicki stated the proposed
Ordinance's language of "not to exceed" was proposed due to the
possibility of the program not continuing beyond the two-year period,
which would eliminate the need to modify the Code to return to a $2.00
charge. Upon motion, duly seconded and by unanimous vote, Council
authorized the City Manager to execute the Memorandum of Understanding
and adopted the following Ordinance No. 96-12 on emergency basis:

BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in
regular session assembled November 12, 1996, that it does hereby amend
Chapter 18--Solid Waste, Article II--In General, Section 18-24--Fee
Schedule of the City Code, as follows:

Sec. 18-24. Fee Schedule.

(a) Collection and landfill charges:
