<br />C" <br />... <br /> <br />TUESDAY <br /> <br />OCTOBER 26. 1954 <br /> <br />Section ll-ADMISSION CHARGE OF FIFTEEN C:ENTS OR LESS. <br />\/here the admission charge to a child under 12 years <br />of age is fifteen cents or less no tax shall be payable. <br />Amounts paid for admission by season tickets or sub- <br />scription shall be exempt only if the amount to be charged <br />the holder or subscriber for a single admission is fifteen <br />cents or less. <br /> <br />An emergency existing, this ordinance shall be in force November <br />1, 1954. <br /> <br />,./- <br /> <br />Also upon motion, duly seconded and unanimously carried by those voting <br /> <br />(Councilman Turner obstaining), Council approved for Mayor Hodnettrs <br /> <br />signature the following agreement bet\.J'een the City of Martinsville and <br /> <br />Rapid Transit Company, Inc., which agreement was prepared pursuant to <br /> <br />Section 11 of the Bus Franchise ordinance adopted b-<J Council on September <br /> <br />28, 1954. <br /> <br />~- <br />~~ <br />~~ <br />i <br /> <br />THIS AGREEMENT, made this 19th day of October, 1954 by and <br />between the City of Martinsville, Virginia, a municipal corp- <br />oration, party of the first part, and Rapid Transit Company, <br />Incorporated, party of the second part: <br /> <br />WITNESSETH: That Whereas the City of Martinsville, Virginia <br />did advertise for sealed bids in accordance with the laws of <br />the Commonwealth of Virginia for the granting of an exclusive <br />bus franchise for the transportation of passengers on the <br />street s and highways of the City of Martinsville, Virginia, <br />which said bids were received on September 14, 1954 at a regular <br />meeting of the City Council of Ma.rtinsville, Virginia; and, <br /> <br />,..- <br /> <br />WHEREAS, it was determined from the bids received that Rapid <br />Transit Company, Incorporated, which was the only bidder, shall <br />receive the award of franchise; and, <br /> <br />WHEREAS, in accordance with law the City Council did award the <br />said franchise to the said Rapid Transit Company, Incorporated <br />of the City of Martinsville, Virginia; and, <br /> <br />WHEREAS, the City Council has passed in accordance with law an <br />ordinance governing the award of said franchise; <br /> <br />- <br /> <br />NOW, THEREFORE, the said party of the second part in consideration <br />of the covenants herein contained doth hereby agree that it will <br />in every respect abide by the ordinance of the City of Martinsville <br />which was passed in its final form on the 28th day of September, <br />1954, and pu-ty of the second part further agrees that it will be <br />
