M. on September Ut, 1954 by W. H. Yeaman, Clerk of City Council, in the Council <br />Chamber, for a franchise granting the exclusive right to operate busses for the <br />transportation of passengers on the streets and highways of the City of Martinsville, <br />Virginia, which said franchise will require that the public convenience and necessity <br />be met. <br /> <br />The proposed franchise to be granted and on which bids will be received as <br />hereinafter set forth will be substantially as follows: <br /> <br />CITY OF MARTINSVILLE, VIRGIlTIA <br /> <br />AN ORDINANCE GRANTING THE EXCIUSIVE RIGHT TC OPERATE BFSSES FOR THE TRANSPORTATION <br />OF PASSENGERS OF THE STR:';ETS AWD HIGffilAYS OF EARTINSVILLE, VIRGINIA? TO ___ <br />_______~__.____ _.1.' (HEREINAFTER CALLED <br />GRANTEE:): TC REQU IRE THAT THE PUBLIC CONVENIENCE AND NECESSITY BE MET: <br /> <br />Section 1. Permission is hereby given the Grantee, its assigns and successors, <br />for a period of fifteen (15) years, from the ____ day of _, 1954, with <br />an option of renewal f')r fifteen (15) years subject to the provisions of Section 10 <br />hereof, to operate motr)r busses for the transportation of passengers over and along <br />the streets and hir;h1;lays ltIi thin said City. <br /> <br />Section 2. The grAnt of this franchise covers the transportation of passengers <br />for hire by motor bus; nothing herein contained shell affect the operation of sight- <br />seeing bussos, taxi cabs, and passenger cnrs for hire not operating upon streets or <br />routes upon any fixed or certain schedule. <br /> <br />Section 3. A sufficient number of busses in good state of repair shalJ_ bo <br />operated by the said Grantee to reasonably accommodate the public convenience and <br />necessity, and transfors from one bus to another shall be granted at such points <br />as will best accommodate the public convenience and necessity. <br /> <br />Section 4. The routes and streets over which the said system of busses shall <br />be operated shall be determined in accordance with the public convenience and <br />necessity as determined by Grantee. Grantee shall establish schedules, fares and <br />service so as to adequately meet tho public convenience and necessity commensurate <br />with earning a fair return on tho investmont of the business. <br /> <br />Section 5. In caGe of fire or accident, repair to streots, or for such other <br />temporary reasons as may render tho proscribed routes impractical, the drivers of <br />said busses shall use such detour as may be prescribed by said City, and until such <br />dotour is prescribod shall use the safest and most practical detour. <br /> <br />Section 6. Bus stops shall be set apart by the Grantee at such stroet inter- <br />sections and other points as the public convonienco and necessity may require, <br />provided the City shall have the right to require the Grantee to relocate such stops <br />if they unduly interfere with the City's traffic plans; stops shall be indicated <br />by markers furnished and erected by the Grantee, except that the Grantee may <br />contract with tho City to supply, erect and maintain the markers for Grantee at <br />Grantee's expense. <br /> <br />~ ....-......." <br /> <br />Section 7. Eofore any driver shall operate a bus for the transportation of <br />passengers under this Ordinance, he shall secure a permit from the sarno City <br />departments from which permits are issued to taxi drivers, attesting to his physical, <br />mental, and moral fitness and capacity for tho said position, and ho must comply <br />with the general laws of Virginia as to chauffeur's license. <br /> <br />Section 8. 1ho ownor of said franchiso shall adopt such rules and regulations <br />as will insuro the., comfort and safety of passengers, and to this end may prohibit <br />smoking upon vehicles, should such prohibition be deemed nocessary for tho safety <br />and comfort of it~; patrons. <br /> <br />Section 9. To insure a proper and adO~late system of accounting, tho said <br />busses shall bo equipped with meters, and tho owner of tho franchise shall install <br />a standard system of bookkeeping, and furnish the City with an annual financial <br />statement prepared by a Certified Public Accountant. It shall make quarterly <br />settlements with the City through such officer as tho Council shall designate, who <br />may inspect and audit the Grantee's books at the City's expense. <br />
