<br />~60 <br /> <br />TUESDAY <br /> <br />JULY 20, 1954 <br /> <br />Section 16. The Martinsville 'City Council, after due notice and hearing, <br />may require the Grantee to show cause vmy his frarchise should not be revoked <br />for failing fDom an overall and comIllunity-vride standpoint to adequately meet the <br />requirements of ~~blic convenience and necessity commensurate with earning a <br />fair return on the investment of the business. In the event the Grantee fails <br />to the satisfaction of the Martinsville City Council to show cause why his <br />franchise should not be revoked, the Council may revoke said franchise provided <br />the Courcil shall act affirmatively on such a proposal at two meetings vrith an <br />interval of at least t.wo weeks separating such EBet.i!".i[-';s. <br /> <br />Alternate Section 16. The }.,lartinsville City COlJ.ncil, after due notice and <br />hearing, may require the Grantee to show cause vlhy his undirected right of <br />operation as to routes, fares, schedules and service should not be suspended for <br />failing from an overall and com.muni t{y--wide standpoint to adequately meet the <br />requirements of public convenience and necessity commensurate va th earning a <br />fair return on the investment of the business. In the event the Grantee fails <br />to the satisfaction of the Mart:~sville City Council to show cause why his <br />undirected right of operation should not be suspended the Co~ il may prescribe <br />by regulation for a period not to exceed one year; routes, schedules, fares and <br />service, provided the overall effect of such regu.lations will not operate to <br />prevent the Grantee from earning a fair return on the investment of the business. <br />To talce such action the Council shall act affirmatively on such a proposal at <br />tvvo meetings with an interval of at least two weeks separating such weetings. <br /> <br />Sec tion 17. This ordinance shall be in full force and effect from the date <br />of it.s passage. <br /> <br />Ci ty Attorney Stone called to the C01illCil's attention the fact that the State Statutes <br /> <br />reqQtre that all public utility franchises be advertised once a week for four consective <br /> <br />'weeks in a local newspaper prior to the asking for bids, whereupon Council, inasmuch <br /> <br />as it had not finally determined the terms and conditions of such a franchise, <br /> <br />indicated that :i. t would consider this matter further and attempt to determine the <br /> <br />terms and conditions at an early date prior to advertising a proposed franchise. <br /> <br />Council was adjourned. <br /> <br />~~JW-~"- <br />W. lI.
