<br />~58 <br /> <br />TUES DAY <br /> <br />JULY 20, 1954 <br /> <br />AN ORDINANCE G:t~4.NTIl~G THE EXCLUSIVE RIGHT TO OPERATE BUSSES FOR THE TRANSPORTNl'ION <br />OF PASSENGEHS on '.['IiE ST.?.EETS AND HIC-li'vVAYS OF I:T.imTHiSVILLE, VIRGINIA, TO RAPID <br />TRANSIT COMPMJY, IHC., A VlliGINIA PUBLIC SERVICE COH.PORl\.TION, (F.EREINAFTER CALlED <br />GRANTEE); TO REQUffiE THAT THE PUBLIC CONVENIENCE AID NECESSITY BE M:ET: <br /> <br />Section 1. Permission is hereby f;iven the Grantee, its assigns and. <br />successors, for a :.:;.eriod of fifteen (1.5) years, from the 1st day of April, 1954, <br />lJIrith an option of renew.al for fifteen (15) years subject to the provisions of <br />Sectio~ 11 hereof, to operate motor busses for the transportation of passengers <br />over and along the streets and highvvays .within said city. <br /> <br />Section 2. The graJ"lt of thjs franchise covers the transportation of passen- <br />gers for hire by motor bus; nothing herein conta:Lned shaH affect the oDeration <br />of sight-seeing busses, ta.v.:icabs, and passenger cars for hire not oper~ting upon <br />streets or routes upon any fixed or certain sciledule. <br /> <br />Section 3. A sufficient number of modern busses in good state of repair <br />shall be operated by the said Grantee to r("asonably accorrrrnodate the public <br />corwenience and necessity, and transfers from on GUS to ar:.other shall be granted <br />at such point as will best accomrnodate the public convenience and necessity. <br /> <br />Section 4. The routes and streets over which the said system 0:: busses <br />shall be operated shall be determined i~ accore-lanco with the public corwenience <br />and necessity as determined by Granteo. Grantee shall establish schedules, fares <br />and service of an Ol)timum cha2~acter Vii th respect to public convenience and <br />necessi ty corrnncnsurate with earning a fair return on the investment of the <br />business. <br /> <br />Section 5. In case of fire or accident, repair to streets, or for such <br />other tempora~f reasons as ~~y render the prescribed routes impractical, the <br />drivers of said busses shall use such detour as may be prescribed by said City, <br />and until such detour is prescribed shall use the sa:f'est and mos t p!'actical <br />detour. <br /> <br />Section 6. Bus stops shall be set apart by the City at such street inter- <br />sec ti ons and other points as the public convenience may require; they s hall be <br />indicated by markers furnished and erected b~r tlle City, at City eX'pense. <br /> <br />Section 7. All busses shall be of modern design and equipped wi th approved <br />safety devices; thoy shall be comfortably heated and .well-lighted on the <br />interior at such hours and under such conditions G.S require lighting, or in the <br />manner nmr or hereafter prescribed by statute. <br /> <br />Section 8. Before any driver shall oper2.te a bus for the transportation of <br />passengers under this Ordinance, he shall secure a permit from the same City <br />departments from vr;,-ich permits are issued to taxi dr:i.vers, D.ttesting to his <br />physical, mental, and moral fitness and capacity for the said position, and he <br />must comply with the general lELws of Virginia as to chauffer's lice:nse. <br /> <br />Section 9. The ollmer of said franchise shall adopt such rules and regulations <br />as will insure the comfort and safety of passengers, and to this end may prohibit <br />smokill.g upon vehicles, should such prbhibition be deemed necessary for the safety <br />and comfort of its patrons. <br />
