<br />L94 <br /> <br />TUES DAY <br /> <br />JANUARY 26, 1954 <br /> <br />A rezoning petition, as follo\'m, as presented by Mr. James C. Stone and Mrs. <br /> <br />Evelyn H. Stone through their Counsel, Attorney M. H. MacBryde, .Jr., upon motion, <br /> <br />was referred to the Planning Commission for its study and recomrendation: <br /> <br />To The Honorable, The Martinsville City Council <br /> <br />Gentlemen: <br /> <br />Your Petitioners, James C. Stone and Evelyn H. Stone, by counsel, respect- <br />fully represent as follovis: <br />(1) That with the exception of two residences facing on the west side <br />of First Street, that the Petitioners are owners in fee-simple of certain <br />realty and improvements thereon situated in Martinsville- City, Virginia, <br />bounded on the north by Fayette Street; on the east by First Street; on the <br />south by "13" Street, and on the west by Second Street; that said realty, <br />exclusive of the improvements erected thereon, is the identical property <br />conveyed Petitioners by County School Board of Henry County, Virginia, by <br />deed dated May 3, 1949, recorded in the City Clerk's Office in Deed Book 16, <br />page 247, to which reference is heremade; and <br />(2) That the portion of said premises fronting on Fayette Street and <br />extending back for a distance of 200 feet is presently zoned as B-1 Business, <br />and is occupied and used for public utility services, trucking terminal and <br />storage yard by Virginia-Carolina Freight Lines, Incorporated as tenant of <br />Peti tioners; and <br />0) That since the acquisition of said realty, Petitioners have erected <br />valuable improvements thereon, greatly increasing their property as well as <br />ta.x values; and <br /> <br />(4) That the balance of the Premises of Petitioners will never be used <br />for other than public utility services and vrill never be available either for <br />residential property or small business purposes, and that it is to the best <br />interest of the City and your Petitioners and other interested parties that <br />the whole of Petitioners premises be rezoned from B-1 Business to B-2 Business, <br />permitting the whole of said premises to be used for public utility facilities, <br />trucking terminal and storage yards; and <br />(5) That the tenant of your Petitioners finds it necessary to expend its <br />trucking terminal facilities and that unless Petitioners property is rezoned <br />permitting the same, it will be necessary for Petitioners to erect additional <br />facilities on the northern side of Fayette street on the property ovmed by <br />Roy C. Stone, upon which the desired facilities may now be legally erected in <br />conformity with the existing zoning restrictions. <br />(6) That lately certain property owners of adjoining property who have <br />heretofore opposed the rezoning of Petitioners property have indicated that <br />they would withdraw their opposition thereto provided tha t Petitioners and Roy <br />C. Stone would agree in writing and for public record that the property of <br />Petitioners sought to be rezoned would not be used for a tire recapping busi- <br />ness and that the entrances to said property be restricted to Fayette Street <br />for a period of 99 years, and further than no trucking terminal facilities be <br />erected on any of the realty presently owned by Roy C. Stone, located on the <br />northerly side of Fayette Street. <br />
