As a matter of record, Councilman Donavant voted against <br /> <br />the motion approving the contracts under the conditions set forth, indicating that <br /> <br />the petitioner should be allowed to file an affidavit similar to that permitted Mr. <br /> <br />R. S. Foley and other developers. It was pointed out that the location of sewer <br /> <br />outfall lines has not been determined in the area of the Foley subdivision but has <br /> <br />been determined in the area of the proposed Lester development and, therefore, <br /> <br />there appeared no need to waive the sewer construction requirements in the Lester <br /> <br />case. <br /> <br />Property owners and residents of Spruce Street and Indian Trail, whose spokesman was <br /> <br />Mr. J. S. Cobb of 721 Indian Trail, personally appeared before Council in support of <br /> <br />their following August 8th inquiry and request: <br /> <br />We believe that the tendency for shopping centers to move out nearer <br />residential areas is desirable. However, to keep from encroaching on <br />residential areas, we believe the zoning laws should be amended to prohibit <br />commercial parking lots in Class A-1 and A-2 residential areas. <br /> <br />Please place this proposal on the agenda for consideration by the <br />Ci ty Council. <br /> <br />Especially were these residents concerned with the reported development of an off- <br /> <br />street parking lot on the south side of Spruce Street presently zoned "A-1 Resi- <br /> <br />dential"; however, Mr. Rives S. Brovm, Jr., President of Lanier Farm, Inc., <br /> <br />personally assured both Council and the petitioners that his firm has and <br /> <br />anticipates no intention of ever developing any parkihg lots on residentially- <br /> <br />zoned properties. Council referred the communication to the Planning Commission <br /> <br />for its consideration and recommendation, noting that the Commission is presently <br /> <br />studying the need for revising and strengthening the City's Zoning Code. <br />
