<br />3: <br /> <br />TUESDAY <br /> <br />JUNE 24.. 1958 <br /> <br />In view of above, I recommend to Council the First National Bank <br />of Martinsville and Henry County be refunded $1,006.47. My <br />recommendation is based on Section 58-1142 Virginia Tax Code which <br />reads as follows: <br /> <br />~:[~ <br />I:,i,a,c, <br /> <br />~l r; <br />l'3 <br /> <br />58-1142. Correction by' Commissioner or other Official Performing <br />his Duties-If such commissioner of the revenue, or other official <br />performing the duties imposed on commissioners of the revenue under <br />this title, be satisfied that he has erroneously assessed such <br />applicant with any such levy, as aforesaid, the commissioner or <br />other official shall correct such assessment. If the assessment <br />exceeds the proper amount, the Commissioner shall exonerate the <br />applicant from the payment of so much as is erroneously charged if <br />not paid into the treasury of the county or city; and if paid, the <br />lZovernine bod.v of the county or ci tv shall. upon the certificate <br />of the cnmmissioner or other qfficial with consent of the town. city <br />9; Commonwealth's attorney that such assessment was erroneous. direct <br />the treasurer of the count.., or city to refund the excess to the <br />taxoayer. If the assessment be less than the proper amount, the <br />commissioner or other official shall assess such applicant with the <br />proper amount. A Copy of any correction made under this section shall <br />be certified by' the commissioner or other official to the treasurer <br />of his county or the treasurer or city collector of his city. S. Foley, petitioning the annexing by the <br /> <br />City of certain of his property described in said request: <br /> <br />I wish to petition the City of Martinsville, to take JJIy' property <br />into the City. <br /> <br />For your information, I have 25 lots in the County of HEIlry, 17 of <br />which on my recent development, Meadowviev Lane; 8 on Mulberry Road; <br />1 joining lot in the City limits; also 13 room dwelling. <br /> <br />I would appreciate the City of Martinsville's consideration in this <br />matter. <br />
