4. Marginal access streets are minor streets which are parallel to and adjacent to arterial streets and highways; and which provide acces s to abutting pro- perties and protection from through traffic. 5. Alleys are minor ways which are used primarily for vehicular service access to the back or the side of properties otherwise abutting on a street. F. Street width shall be the total width of the strip of land dedicated or reserved for public travel, including roadway, curb, gutters, sidewalks, and planting strips. Q. The term subdivision means the division of a parcel of land into two (2) or more lots or parcels for the purpose of transfer of ownership or building development, or, if a new street is involved, any division of a parcel of land; provided that a division of land for agricultural purposes into lots or parcels of five (5) acres or more and not involving a new street shall not be deemed a subdivision. The term include,s resubdivision and, when appropriate to the context, shall relate to the process of subdividing or to the land subdivided. r'- R. The term subdivider shall refer to an individual, corporation or registered partner- ship, owning any tract, lot, or parcel of land to be subdivided; a group of two or more persons owning any tract, lot or parcel of land to be subdivided, who have given their power of attorney to one of their group or to another individual to act in their behalf in planning, negotiating for, in representing, or executing the purposes of the subdivision. SECTION III - ADMINISTRA TION A. In accordance with Section 15 - 784 Code of Virginia, and unless otherwise provided herein, the provisions of this ordinance shall be administered by the Planning Commission acting for, and as agent of, the City Council and approval or disapproval by the Commission shall constitute approval or disapproval as though it were given by the City Council as the governing body. B. The agent of the Commission shall perform such duties as regards subdivision and subdividing as are designated by this ordinance. SECTION IV - PROCEDURE A. Pre-application Frocedure 1. Frevious to the filing of an application for conditional approval of the preliminary plat the subdivider shall consult early with the agent of the Commission con- cerning the subdivision plans of the subdivider. It is the intent of this require- ment that the subdivider may familiarize himself with these regulations and that the agent of the Commission and such personnel of the City as may be appropriate and concerned shall be afforded by the subdivider opportunity to advise and assist the subdivider prior to the preparation of the preliminary plat and related material. - 3 -
