<br />r <br /> <br />~ <br /> <br />[ <br /> <br />MARTINSVILLE SUBDIVISION REGULATIONS <br /> <br />AN ORDINANCE TO REGULATE AND ASSURE THE ORDERLY SUBDIVISION AND <br />1EVELOFMENT OF LAND IN THE CITY OF MARTINSVILLE, VIRGINIA, as authorized <br />oy the Virginia Land Subdivision Act. Article 2. Chapter 23, Code of Virginia 1950 with <br />amendments thereto; Requiring and Regulating the Preparation and Presentation of Pre- <br />liminaryand Final Flats for such Purpose; Establishing Minimum Subdivision Design <br />Standards; Providing Minimum Improvements to be made or Guaranteed to be Made by <br />the Subdivider; Establishing City F olicy for the Partial Reimbursement to the Developer <br />for Such Improvements; Setting Forth the Procedure to be Followed by the City Flanning <br />Commission in Applying These Rules; Regulations and Standards; Making Allowance for <br />Variations in the Regulations Under Certain Conditions; Prescribing Penalties for the <br />Violation of Its Provisions; Setting Forth Appeals Procedure; and Other R elated Matters. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MARTINSVILLE, <br />VIRGINIA: <br /> <br />SECTION I - PURPOSE AND TITLE <br /> <br />A. Purpose. There are hereby established subdivision standards and procedures for <br />the City of Martinsville. In their interpretation and application, the provisions of <br />this ordinance shall be held to be expedient and necessary for the health. safety, <br />convenience. and prosperity of the public. Such provisions are intended, among <br />other purposes. to provide for permanently wholesome community environment, <br />adequate municipal services and utilities. and safe and adequate streets. <br /> <br />B. Title. This ordinance is known and may be cited as the "Subdivision Ordinance <br />of Martinsville, Virginia". <br /> <br />SECTION II - DEFINITIONS <br /> <br />For the purpose of this ordinance, certain words and terms used herein shall be in- <br />terpreted or defined as follows. and words used in the present tense include the future <br />tense. the singular includes the plural. and the plural the singular. unless the natural <br />':onstruction of the word indicates otherwise; the word "lot" includes the words "plot". <br />and "parcel"; the wo rd "shall" is mandatory and not directory; the word "approve" shall <br />be considered to be followed by the words "or disapprove"; any reference to this ordinance <br />includes all ordinances amending or supplementing the same; and all distances and areas <br />refer to measurement in a horizontal plane. <br /> <br />A. Agent shall refer to the duly designated agent of the City Planning Commission. <br />or where specifically indicated. to the agent of the City Manager of the City of <br />Martinsville. Virginia. <br /> <br />B. City Engineer shall refer to the Director of the Public Works Department. <br /> <br />- I - <br />
