<br />THURSDAY <br /> <br />SEPTE~BER 19, 1957 <br /> <br />and (3) declared that, provided the required majority of registered freeholders and <br /> <br />non-freeholders approve the issuing of $2,500,000 for the purposes set forth in the <br /> <br />aforementioned ordinance, effective January 1, 1958 a mont..~ly sewer service charge <br /> <br />(to replace the present sewer service charge) of an amount equal to lOO% of each locaJ <br /> <br />customer's monthly vvater bill shall be assessed against and collected from each <br /> <br />respec tive water user, subject to such exception the Council shall determine regardin€ <br /> <br />the few wat.er customors it will be impractical for the City to provide sewer service. <br /> <br />The ordinance as am.ended and adopted follows: <br /> <br />AN CRDINANCE AUTHOEIZING THE ISSUANCE OF $2,500,000 OF BOliJDS OF THE CITY OF <br />MARTIlSVILLF. TO FINANCE THE COST OF IMPROVIID THE CITY'S SEWAGE DISPOSAL <br />SYSTEH At'rD PROVIDING FOR THE SUBMISSION OF THE QUESTION OF ISSUING SAID BOl'-JW <br />TO THE QUALIFIED VOTERS OF THE CITY. <br /> <br />V<ffiEREAS, the City of Martinsville has, for many years, w~intained and <br />operated a sewage disposal system for the collection and disposal of sewage, <br />and the Council of said City deems it advisable that said sewage disposal <br />system shall be improved in the manner hereinafter set forth; and <br /> <br />~rnEREAS, said City has been deriving a revenue from the operation of <br />such sewage disposal system and such sewage disposal system is now and, when <br />it has been improved in the manner hereinafter set forth, will be a specific <br />undertaking from which the City may hereafter derive a revenue within the <br />meaning of Section 127 of the Constitution of Virg.inia; NOW, THEREFORE, <br /> <br />HE IT ffiDAI.NED by the Council of the City of Martinsville, Virginia, <br />as follows: <br /> <br />Section 1. The Council of the City of MartinBv:i.lle has ascertained <br />and hereby detennines that the public interest requires that the sewage <br />dispof::al system maintained by the Cit-y shall be improved by constructing <br />and equipping a sewaGe treatment plant to be located on a suitable site, <br />and by corn tructing the intercepting sewers necessa.ry to connect the City's <br />existing sewage disposal system with such sewage treatment plant, and by <br />constructing additional sewers needed for the collection of sewage, and by <br />acquiring the lands or rights in land required for the making of such <br />improvements, and that it is expedient that said Ci-bJ shall borrow money and <br />contract indebtedness and issue its bonds, as hereinafter provided, to finance <br />the cost of such improverents. <br /> <br />Section 2. In orde,:, to finance the cost of making said improvements to <br />said cewage disposal system, the City of Martinsville shall issue its <br />negotiable bonds of the aggregate principal amount of $2,500,000 pursuant to <br />and in accordance with Cha.pter 193 of the Acts of 1950 of V:irginia, and also <br />Article 3.l of Chapter 22 of Title 15 of the Code of V:irv,inia, 195o. Said <br />bonds shall be issued under aDd in compliance with the provisions of Clause <br />(b) of Section 127 of the Constitution of Virginia, and, subject to the <br />condit.ions prescribed by said clause, shall not be included within the other- <br />wise authorized indebtedness of said City. <br />
