<br />~56 <br /> <br />TUESDAY <br /> <br />JULY 25. 1961 <br /> <br />Upon motion, duly seconded and carried, Council adopted the folLowing ordinance <br /> <br />amending A.rticle XII, Chapter 9, of the Code of the City of Hartic:svilJe, b;y <br /> <br />adding Section 9-178.1 thereto to correct a present conflict vrith tho State <br /> <br />Code as amended by the Virginia General Assembly \lith respect to cOiwictions <br /> <br />for reckless driving and drunk driv1ng arising from the same act or <br /> <br />occurrence: <br /> <br />BE IT o..qnAINED, by the Council of the City of Hartirwville, V:i1rginia, <br />in regular meeting as:3embled this tvlenty-fifth day of July, 1961, <br />that Chapter 9 of Article XII of the Code of the City of Hartinsville, <br />Virginia, 1956, and as amended, be and is hereb:r amended to conform to <br />Section 19.1-259.1 of the Code of Virginia, 1950, and as amended, by <br />addi?:1G the fol'.mJing section: <br /> <br />Section 9.178.1. T,{nencver any person is charGed '^lith a <br />violation of Section 9-169 and with reckles~3 driving <br />growing out of the same act or acts and is convicted of <br />one of these charges, the cOlrrt shall dismiss the <br />remaining charge. <br /> <br />An emergency existing, this ordinance sl~ll be in force from date <br />of passage. <br /> <br />A special Council conunittee, composed of Councilman E. E. Stone and Thomas J. <br /> <br />Burch, recommended that the City provide additional plaYGI'ound facilities for <br /> <br />tlLHtle Leagucll recreational activities, particularly at l5ro.....m. Street Field, <br /> <br />Patrick Henry Elementary School, and Clcarview School, to implement present <br /> <br />facilities mmed by the City and the field on Brool::dale Street owned and <br /> <br />sponsored by the Civitan Club. Council requested that City Hanager Hirst <br /> <br />confer \-lith the Com:nittee to develop cost figures on these proposed <br /> <br />improvements. <br /> <br />Council discussed .various aspects relating to the operation \4ithin the City's <br /> <br />corporate limits of ice cremn trucks, especially in the residential area; <br /> <br />hOHever, Council took no action. <br />
