They do not, I feel, have the right to set <br />aside the property for the use of the hosDital until such time as the <br />hospital feels tl:at it neccs the property. <br /> <br />The Planning Commission might decide, in theory, that the city should <br />own all of the property betvreen the Post Office and Mos~" street for <br />subsequent use by the city in municipal buildinGS, but I believe it <br />would be beyond the commission's scope or pouer to deny a lop;lcal <br />sale of the -oroperty by a c;tizen to a citizen merely because they <br />might feel that ideally the city should O\.m the property. It is my <br />conviction that it is f;I'ossly unfair, if not i11e[;al, and that it is <br />beyond the scope of tho PlanninG' Commission to deny the rezoning of <br />the property on the basis that they thing the hospital 'should own <br />the property.' In my experience in the real estate business, I have <br />seon property that I felt that the city should ovm, but I have felt <br />that if they should own it, they should bU~T it. <br /> <br />I.TnUe I acknowledge the meritorious service of the Planning Commission <br />and their great value to our connnurlity, I hope that the council will <br />recognize the dangers and inequities of a commission under their juris- <br />diction arbitrarily denying this and similar requests for rezoning, <br />based o~ the fact that they believe someone else should 0\.]11 the property. <br /> <br />Respectfully yours, <br /> <br />Brooks R. Jones, Jr., <br /> <br />in connection with the requested closing of a portion of Cheshire Street (see Council <br /> <br />minutes of ~~y 23, 1961), and reported that procedures are in process for <br /> <br />compliance with the statutes for the closing of said street portion, pending <br /> <br />confirmation of tr:e Board of Viewers' report already submitted and pending Council's <br /> <br />final action thereon at its next regular meeting to be h el d August 8, 1961. <br /> <br />In considering the drainage conditions at the new l;Jcst End Elementary School, as <br /> <br />brought to Council's attention by the City School Board, CouncilapproDriated <br /> <br />from its Emergency Fund the sum of $9(JG.OO to the Public Forks Department to <br /> <br />Drovide fU11ds for correcting these drainage conditions in the event the School Fund <br /> <br />is unable to absorb the cost from its budget. <br />
