<br />Section 16. No Exclusive Franchise. The rights herein granted the
<br />grantE~e to construct, maintain, or operate or to perform any other act or
<br />exercise any other privilege under this franchise shall not be construed
<br />as exclusive or as preventing the city from grantin~ to any other person,
<br />firm, or corporation, the saIIE or similar franchise rights and privileges
<br />to be exercised in and upon its streets and such of the same and parts
<br />thereof as the city may deem best or choose to allow, permit, give, or
<br />grant.
<br />
<br />Section 17. Forfeiture. The violation of any material portion of
<br />this franchise by the grantee or i ts success or in interest, or its failure
<br />promptly to perform any of the provis ions of this ordinance, s hall be cause
<br />for the forfeiture of the franchise contract granted by this ordincnce and
<br />the termination of all rights hereunder. Such forfeiture shall be accomp-
<br />lished by resolution of the city council after written notice to the grantee,
<br />and by continuation by the grantee of the violation, failure or default
<br />specified in the notice for at least ninety (90) days from the date the
<br />notice is served. In the event of forfeiture as herein set forth, the city
<br />may proceed as prescribed in Section 8 of this franchise or in such other
<br />manner as the city council may deem best in an endeavor to maintain tele-
<br />phone service to the custoIlErs in the city of the grantee.
<br />
<br />Section 18. Lien of City. All debts, penalties, or forfeitures
<br />accruing to the city under the terms of this ordinance shall constitute a
<br />lien upon the property and franchises of the said grantee within the city,
<br />subject, however, to then-existing prior liens.
<br />
<br />Section 19. Jurisdiction of Governmental Regulator~ Commissions.
<br />Where any provision of this franchise is in conflict wit an,V laWful rule
<br />of the Ccrporate Commission of the Commonwealth of Virginia, or other con-
<br />stituted body or commission legally authorized to prescri.be rules governil'l?:
<br />the conduct of the company, so that the grantee cannot reasonably comply with
<br />both the provisions of this ordinance and the rule of such Commission or
<br />body, then the grantee shall comply with such rule instead of the conflicting
<br />provision of this ordinance, but the grantee shall comply vIith all of the
<br />provisions of this franchise where such can be done without violating valid
<br />statutes or rules of the said Commission or body.
<br />
<br />Section 20. General Ordinances of the Ci~. The rights and privileges
<br />herein granted areexpressly subject to the conditions, limitations and
<br />provisions contained in the general ordinances of the city in force relative
<br />to the use of streets or public places of said city so far as they may be
<br />applicable to the rights and privileges herein granted, and to any and all
<br />ordinances which may be hereafter passed by the city applicable thereto in
<br />the exercise of the police power or any other power vested in said city for
<br />the regulation of public service corporations using the streets of the city;
<br />and the city expressly reserves the right to pass all such reasonable ordin-
<br />ances for the regulation of the use of the streets and the exercise of the
<br />rights and privileges herein granted.

<br />SE~ction 21. Effective Date. ~~
<br />Effective Date. This ordinance shall be in force from and after
<br />the 15th*<iay or July, 1961.
<br />
