<br />;22 <br /> <br />TUESDAY <br /> <br />JUNE 6. 1961 <br /> <br />Section 20. General Ordinances of the City. The rights and <br />privileges herein granted are expressly subject to the conditions, <br />limitations and provisions contained in the general ordinances of <br />the city in force relative to the use of streets or public places <br />of said city so far as they may be applicable to the rights and <br />privileges herein granted, and to any and all ordinances which may <br />be hereafter passed by the city applicable thereto in the exercise <br />of the police power or any other power vested in said city for the <br />regulation of public se~lice corporations using the streets of the <br />city; and the city expresslJ" reserves the right to pass all such <br />reasonable ordinances for the regulation of the use of the streets <br />and the exercise of the rights and privileges herein granted. <br /> <br />Section 21. Effective Date and Franchise Bids. <br /> <br />Subsection a. Effective Date. This ordinance shall be in <br />force from and after the 15th day of July, 1961 and shall not be <br />published. <br /> <br />Subsection b. Advertisement for Franchise Bids. Upon approval <br />of this ordinance by the City Council in the manner prescribed by law, <br />it shall be the duty of the clerk of the council to cause it to be <br />advertised once a week for four (4) successive weeks in the Martinsville <br />Bulletin, and such other newspapers of general circulation as deemed <br />desirable, and to extend invitation for bids for the rights, privileges <br />and franchises to be granted in and by said proposed ordinance, copies <br />of which shall be available in the city manager's office for distribution <br />to persons mailing inquiry. The advertisement shall notify that the bids <br />are to be in 'Writing and shall be delivered to the office of the city <br />manager of the city not later than 12 Noon, E.S.T., July 10, 1961, which <br />bids shall be presented by the city manager to the city council, to be <br />dealt with or acted upon in the mode prescribed by law. Said advertisement <br />shall expressly reserve the right of city council to reject any and all <br />bids. <br /> <br />Subsection c. Procedure for Acceptance of Bids. All bids for the <br />franchise, rights, and privileges to be granted in and bJ this ordinance <br />shall be submitted in vITiting and each bidder shall file with his bid a <br />bond executed in favor of the City of Martinsville, in the penalty of <br />ten thousand dollars, with surety and in form satisfactory to the city <br />attorney, and conditioned as follows: <br /> <br />(1) That if his or its bid is accepted and an ordinance sub- <br />stantially in the form aforesaid is passed granting to him or it the <br />franchise, rights, and privileges hereinbefore set forth, then he or it <br />will, within thirty days from and after the approval of the ordinance <br />making said grant and before the date on which the same shan become <br />effective as herein provided, file a written acceptance of the same vnth <br />the clerk of the council, in for~ to be approved ~r the city attorney. <br /> <br />(2) That at the same time that said l.Jritten acceptance is filed, <br />he or it will execute and file Hi th the clerk of the council a bond as <br />provided for in Subsection b of Section 13 of this ordinance. <br />
