<br />~20 <br /> <br />TUESDAY <br /> <br />JUNE 6. 1961 <br /> <br />Section 9. City Use Grantee Facilities. The grantee shall <br />provide a suitable space when so required Qy the city, not to exceed <br />the total equivalent of one cross arm on each pole and not exceeding <br />a total of one duct in anyone of the grantee's conduits, free of <br />charge and for the purpose of carrying wires of the police or fire <br />department telephone system or of the telegraph, signal or radio <br />system each or all as owned or may be owned and maintained Qy the <br />city, provided the said wires are placed and maintained in such a <br />manner as may be prescribed by the grantee, and in no case used to <br />carry electric light or high-tension currents. <br /> <br />Section 10. Taxes. Nothing in this ordinance shall be <br />construed to prevent the grantor from levying' any la,nul tax on the <br />properties of the said grantee or from levying any lawful business <br />tax on the said grantee for the privilege of doing business wlthin <br />the city. <br /> <br />Section 11. Safety Methods and Equipment. The grantee shall at <br />all t:imes employ a high standard of care and shall install and maintain <br />in use approved methods and devices for preventing failures or accidents <br />which are likely to cause damages, injuries or nuisances to the public. <br /> <br />Section 12. New Developments. Should, within the period of this <br />franchise, developments in the field of transmission of messages and <br />telephoning services offer to the grantee the opportunity to more effectively, <br />efficiently or economically serve its customers through use of methods, <br />materials or Drocedures not prescribed or embraced by the te~s of this <br />franchise, then the grantee may petit10n the city council for review of <br />this franchise in line with such developments. <br /> <br />Section 13. Liability. <br /> <br />Subsection a. Damage Claims. The grantee shall be liable for <br />and shall pay all damages which may result to persons or property within <br />the city by reason of the construction, installation, maintenance, or <br />operation of such telephone system, poles, towers, wires, cables and <br />conduits including claims for damages and judgments against the city due <br />to location or existence of equipment and facilities of the grantee or <br />due to obstructions or defects in any street or alley which are in fact <br />due directly or indirectly to the construction, operation or repair of <br />structures owned or operated by the grantee, during the term of this <br />franchise. The grantee shall defend the city against all suits arising <br />hereunder . <br /> <br />Subsection b. Surety Bonds. Upon acceptance by the grantee of <br />a franchise contract under the conditi.ons of this ordinance and before the <br />grantee shall have any rights hereunder, the grantee shall file with the <br />clerk of the city council for the benefit of the city a corporate bond, <br />in a form to be approved Qy the city, in the sum of five thousand dollars <br />($5,0~O), securing it against the carelessness, negligence, or fault of <br />the grantee, or against any defalut upon the part of the grantee whereby <br />the city shall be damaged, and conditioned to the effect that the grantee <br />will comply in all respects "lith the terms, provisions and conditions of <br />this ordinance. <br />
