<br />announced its resUDlption of plan prepa~ation for the widening and reconstruction

<br />of East Church Street from Bool:er Road. to Chat.ham. IIe:tghts (Rnut,es 57 an6 53)/

<br />City 1.~nager Hirst reported that recently, in the course of land g~ading by
<br />and on property owned bJ Hr. J. Ben Dayis and located just o'-ltside the City's
<br />"'outh corporate limits on the north side of Haute 220 South, a s(,\Je::.~ Line serving
<br />the Hil1crest-Rivermont Court a~~ea and located on 1<1'. Davis' property i.J8.S
<br />destroyed, resLLl ting in a hazardous health cOeldi tion to residents of the area.
<br />Hr. Hirst further reported that, Hhile the line l>lC1.S bu::..lt some years ago by

<br />private interests, the responsib~.l~Lty for maintenance has been assumed b~T the
<br />
<br />Ci ty although no recorded eas ement across the property is 0:1 file. Council agreed,
<br />
<br />
<br />neverthless, to share on a "5J-50" basis 'dith the property owner (lIr. J. :Sen Davis)

<br />
<br />in tho cost of replacins the approximately '175 feet of')stroyed, provided that tbe

<br />
<br />property ovmer and/or h::'s succe:osors ,.rill comply vIi th all applicable City
