:8 TUESDAY AUHJST 11, 1959 The regular semi-monthly meeting of the Council of the City of Martinsville, V:i.r ginia, with Mayor John W. S hul tz pr-es iding, was he ld in the C ounc il Chamber, City Hall, Tuesday, August ll, 1959, at 6:30 P.M., the following members being present: Mayor and Councilman John W. Shultz; Vice-Mayor and Councilman E. E. Stone; and COill1cilman Thomas J. Burch. A proposed gas utility franchise ordinance, as placed on first and second readings by Council .July 14, 1959 and July 28, 1959, respectively, and as amended to provide for the ad:vl~rtising thereof--cost of which is to be paid by Southwestern Virginia Gas Compal1V--and as amended to provide for the receiving of bids thereon on September 8, 1959, was unannnously adopted, as follows: AN ORDINANCE TO PROVIDE FOR THE GRANTING BY THE CITY OF MARTHBVILIE, VJRGINIA, TO A PERSON OR PERSONS, at TO A CORPORATION, HEREAFl'ER TO BE ASCERTAINED IN THE :MANNER PRESCRIBED BY lAW, A NON-EXCLUS IVE FRAl~HISE nIGHT Fat THE TERM AND UPON THE CONDITION:> HEREIN STATED TO D.1PORT, TRANSPORT, SELL AND DISTRIBUTE NATURAL GAS, OR A MIXTURE OF NATURAL AND MANUFACTURED GAS, WITHIN THE LIMITS OF THE CITY, A ND FOR THESE PURPOSES TO ESTABLISH THE NECESSARY FACILITIES AND EQUIPMENT AND TO lAY AND MAINTAIN GAS Mf..DS, SERVICE PIPES AND OTHER APPURTENANCES NECESSARY TO THE SALE AND DISTRI- BUTION OF GAS IN AND ALONG THE STREETS, ALIEYS, AVENUES, HIGHNAYS AND OTHER PUBLIC PLACES OF THE CITY AND TO DO ALL THINGS vrnICH ARE REASONABLY NECESSARY OR CUSTOMARY IN THE ACCOMPLISHMENT OF THESE OBJEX::TIVES; TO PROVIDE FOR THE ADVl"~TISING FOR BIDS FOR SUCH FRANCHISE, THE ACCEPTANCE OF BrIG AND OTHER MATTERS RELATING THERETO. BE IT ORDAINED BY THE C OUNC IL OF THE CITY OF MARTINSVILIE: Section A. That there be granted in the manner prescribed by law, the non-exclusive franchise right and privilege to erect, construct, operate and maintain a gas plant, gas system or both, and to import, transport, sell and distribute natural gas, or a milcture of natural and manufactured gas, within the limits of the City, and for these purposes to establish the necessary facilities and equipment and to lay and maintain gas mains, service pipes and other appurtenances necessary to the sale and distribution of gas in and along the streets of the City and to do all things vmich are reasonably necessary or customary in the accomplislunent of these objectives, said franchise right and privilege to be granted by an Ordinance to be in substantially the following language:
