<br />for four successive weeks an invitation for bids for the rights, privileges and franchises <br /> <br />to be granted in and by said proposed ordinance, copies of which shall be available in the <br /> <br />city manager I s office for distribution to person s making inquiry. The advertisement <br /> <br />,_ shall notify that the bids are to be in writing and shall be delivered to the office of the city <br /> <br />manager of the city not later than 11 A. M. Eastern Standard Time, July 2, 1959, which <br /> <br />bids shall be opened at that time and presented by the city manager to the city council, to <br /> <br />be dealt. with or acted upon in the mode prescribed by law. Said advertisement shall <br /> <br />expressly reserve the right of city council to reject any and all bids. <br /> <br />r' <br /> <br />Subsection c. F rocedure for Acceptanc e of Bids. All bids <br /> <br />for the franchise, rights, and privileges to be granted in and by this ordinance shall be <br /> <br />submitted in writing and each bidder shall file with his bid a bond executed in favor of <br /> <br />the City of Martinsville, in the penalty of ten thousand dollars, with surety and in form <br /> <br />satisfactory to the city attorney, and conditioned as follows: <br /> <br />(1) That if his or its bid is accepted and an ordinance sub- <br /> <br />stantially in the form aforesaid is passed granting to him or it the franchis e, rights, and <br /> <br />privileges hereinbefore set forth, then he or it will, within fifteen days from and after <br /> <br />the approval of the ordinance making said grant and before the date on which the same <br /> <br />shall become effective as herein provided, file a written acceptance of the same with the <br /> <br />clerk of the council, in form to be approved by the city attorney. <br /> <br />(2) That at the same time that said written acceptance is <br /> <br />filed, he or it will execute and file with the clerk of the council a bond as provided for <br /> <br />in subsection c of Section 14 of this ordinance. <br /> <br />(3) The clerk of the council shall, upon acceptance of the <br /> <br />bid of any bidder, return to the unsuccessful bidders the bonds filed with him by them <br />- <br /> <br />- 16 - <br />
