<br />In order to take advantage of the Appalachian Power Company's most
<br />
<br />favorable filed tariff available to the City of Martinsville for the
<br />
<br />purchase of electric energy by the City from Appalachian, as provided
<br />
<br />by the "Rate (Alternate)" clause under Section 5 of the Electric
<br />
<br />Service Agreement between Appalachian and the City, dated March 8, 1960,
<br />
<br />and revised February 12, 1963, Council unanimously adopted the following
<br />
<br />resolution accepting the revision to said agreement and authorizing
<br />
<br />Mayor Wilson to execute for the City said revision, as set forth in letter
<br />
<br />dated July 10, 1964, from Mr. James B. White, Manager of Appalachian's
<br />
<br />Fieldale Division:
<br />
<br />WHEREAS, with the approval of the Corporation Commission of the
<br />Commonwealth of Virginia, the Appalachian Power Company on June 1,
<br />1964, effected certain revisions to its electric tariffs; and
<br />
<br />WHKSEAS, under the provisions of Section 5 of the Electric Service
<br />Agreement between the Appalachian Power Company and the City of
<br />Martinsville, dated March 8, 1960, and revised February 12, 1963,
<br />the City of Martinsville has the option of being billed for electric
<br />energy purchased from the Appalachian Power Company on and by such
<br />tariff as might be available to Appalachian's other large users of
<br />electric energy in the vicinity of Martinsville, should such tariff
<br />be advantageous to the City of Martinsville; and
<br />
<br />WHEREAS, it is deemed by the Coun~il of the City of Martinsville,
<br />Virginia, that the tariff set forth in letter dated July 10, 1964,
<br />from Mr. James B. White, Manager of Appalachian's Fieldale division,
<br />is advantageous to the City of Martinsville; now, therefore,
<br />
<br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia,
<br />in regular meeting assembled this twenty-eighth day of July, 1964,
<br />that it does hereby accept the revision to said Electric Service
<br />Agreement in the form set forth in the said Mr. White's letter dated
<br />July 10, 1964; and, further,
<br />
<br />BE IT RESOLVED by said Council that its Mayor, the Honorable J. Frank
<br />Wilson, be and is hereby directed to indicate said acceptance by the
<br />City of said revision in the manner and form prescribed by the
<br />Appalachian Power Company; and that the Clerk of the Coun~il be and
<br />is hereby directed to file with the Appalachian Power Company a copy
<br />of this resolution.

<br />In accordance with approval given July 14, 1964, by the Planning Commission,
<br />
<br />Council unanimously agreed to enter into a contract with Mr. Whitney Shumate
<br />
<br />for the development--under the City's subdivision regulations--of a portion
<br />
