<br />2J <br /> <br />TUESDAY <br /> <br />APRIL 28, 1964 <br /> <br />~- <br /> <br />Vehicles & Traffic Code of the City of Martinsville be amended and <br />revised by replacing Section 9-178 thereof with the following: <br /> <br />Sec. 9-178. Same--F'enalty for reckless driving. <br /> <br />.- <br /> <br />EJery person convicted of reckless driving under sections 9-174, <br />9-175, 9-176 or 9-177 shall for the first violation be punished <br />by fine not exceeding five hundred dollars or confinement in <br />jail not exceeding twelve months, or both, in the discretion of <br />of the jury or of the court trying the case without a jury. For <br />second or subsequent conviction for the offense of reckless <br />driving under sections 9-174, 9-175, 9-176 or 9-177 committed <br />within twelve months before or after the date of another act <br />of reckless driving for which he has been convicted, such <br />person shall be punished by a fine of not less than one hundred <br />dc, lIars nor more than five hundred dollars, or by imprisonment <br />ir- jail for not leSE: than ten days nor more than twelve months, <br />or by both such fine and imprisonment. <br /> <br />An emergency existing, this ordinance shall be in force from date of <br />adoption. <br /> <br />Virginia Code reference 18.1-9; 1950 Code <br />46.1-192; 1962 Supplement <br /> <br />In discussing portions of the Traffic Code, particularly as to current practices <br /> <br />and requirerrlents with regard to pedestrian cross-walks, Council unanimously directed <br /> <br />that tlschool crossings" and pedestrian crossings in the downtown business area, <br /> <br />where not controlled by IIstop-light", be clearly marked and identified. <br /> <br />- <br /> <br />Attorney M. Harrison Joyce, representing the Whittle Family Irrevocable Trust, and <br /> <br />Attorney Douglas K. Frith, representing Lanier Farm, Inc., each appeared before <br /> <br />and informed Council that pre-trial conferences have been scheduled for Saturday, <br /> <br />June 27, 1964, by a duly-constituted court to hear--and act upon--the separate <br /> <br />petitions filed by the Whittle Trust and Lanier Farm, Inc., seeking the annexing <br /> <br />to the City of Martinsville of certain of their properties. These petitions, <br /> <br />- <br /> <br />according to the representatives of the petitioners, are of record before the <br /> <br />court--having been filed prior to the City's annexation petition dated May 4, <br /> <br />1962--and are the same as thoEle presented to City Council under the following <br /> <br />dates, as follows: <br />
