) ,? -i '" () ~ THURSDAY NOVEMBER 9. 1967 City of Martinsville to the party of the second part by deed of September 26, 1967, and of record in Henry County, Virginia, Circuit Court Clerk's Office in Deed Book 207, Page 452. Said easement and right of way herein conveyed being more particularly described as follows: BEGINNING at a point in the centerline of a siding, now under co~struction by the Norfolk and Western Railway, said beginning point being 8.39055'59" W., approximately 11 feet from the southerly right-of-way line of the Norfolk and -Western Railway along the dividing line between property owned by the Frith Family Trust and the City of Martinsville; thence leaving said point of beginning in an easterly direction and with the centerline of said siding, approx- imately 241 feet to a point at which said centerline intersects the southerly right-of-way line of the Norfolk and Western Railroad at Station 4+00*. The above description is alo~g the centerline of the aforementioned siding as shown on N. & W.lS Plan #V-7-VA.134 & 135, entitled, "Pro. Siding to 8erve Frith Construction Company", as prepared by the Norfolk and Western Railway, Shenandoah Division- Winston Salem District, dated May 1, 1967. A detailed map of the above described property is now being prepared and after said map has been completed and approved by the City of Martinsville, said map shall be recorded in a current map book in the aforesaid Clerk1s office, and the description of the above referred to property as shown on said map shall have precedence over the description as included herein. The easement and right-of-way herein granted being for the express purpose of the extension of a railway track over the property of the party of the first part and connecting with the main line track of the Norfolk & Western Railway Company adjacent thereto, and as part of the consideration of this conveyance it is expressly understood and agreed between the parties hereto that should the easement and right- of-way herein granted cease to be used for the purpose herein stated, set out and dedicated, then the same shall immediately revert to the City of Martinsville, Virginia, or its assigns. IN WITNESS WHEREOF, the Council of the City of Martinsville, Virginia, has caused its Mayor, Fred T. Renick, to sign its corporate name to this deed and has caused its seal to be affixed hereto attested by W. H. Yeaman, its Clerk of Council, this day and year first above written.
