<br />27 <br /> <br />TUESDAY <br /> <br />OCTOBER l2, 1971 <br /> <br />prov~s~ons have been or may be amended <br />City hereby agrees to pay its cost for <br />becoming covered hereunder; and, <br /> <br />from time to time; and, (that) said <br />participation of such employees <br /> <br />BE IT FURTHER RESOLVED by said Council that T. B. Noland, City Manager, and <br />W. H. Yeaman, Clerk of Council, be and are hereby authorized and directed <br />in the name of said City to execute any required contract in order that the <br />above-described employees of the City of Martinsville may become entitled <br />to benefits provided for law enforcement personnel under the Virginia <br />Supplemental Retirement Act; and <br /> <br />~-, <br /> <br />BE IT FURTHER RESOLVED by said Council that, in execution of any such <br />required contract, the seal of said City shall be affixed thereto and <br />attested by said Clerk of Council, and said officers of the City of Martins- <br />ville are hereby authorized and directed to do any other thing, or things, <br />incident and necessary in the lawful conclusion of this matter and in <br />conformity with law. <br /> <br />Mr. Earle W. Greene, Realtor, Agent for Fralin & Waldron, Inc., who initiated <br /> <br />the rezoning petition approved by Council on August l7, 1971 as to the Whittle <br /> <br />Family Trust tract off Brookdale Road, on which Fralin & Waldron proposes to <br /> <br />construct and operate a nursing home, appeared before Council in support of this <br /> <br />firm's request (filed September 28, 1971) that Council endorse the project and <br /> <br />the need therefor in support of this firm's efforts to obtain reinstatement of <br /> <br />a "Certificate of Need" issued March 5, 1971 by the Virginia Department of Health. <br /> <br />In response, Council indicated that it has demonstrated its cooperation, insofar <br /> <br />as Council is permitted, by rezoning the aforesaid property for the intended <br /> <br />/~ <br /> <br />usage; furthermore, Council expressed its opinion that it has neither the quali- <br /> <br />fications nor the jurisdictional authority either (1) to determine whether a <br /> <br />local-or-area need for such a facility exists or does not exist or (2) to involve <br /> <br />itself in private enterprise's financing methods. Being cognizant of the fact <br /> <br />that petitioner's efforts toward this end appropriately should be addressed to <br /> <br />- <br /> <br />the West Piedmont Planning District Commission, Council--upon motion, duly <br /> <br />seconded and carried--requested said Commission "to consider giving the Fralin <br /> <br />& Waldron project its (Commission) endorsement". <br />
