<br />') <br />- <br /> <br />TUESDAY <br /> <br />MAY 11, 1971 <br /> <br />Also, pursuant to duly-advertised public notice, the Council and the Planning <br /> <br />Commission conducted a joint public hearing on Nationwide Homes' petition <br /> <br />(dated April 5, 1971) requesting the vacating and closing of a portion of <br /> <br />Forest Street Extension and the vacating and closing of an unnamed street <br /> <br />which extends from said Forest Street Extension into petitioner's industrially- <br /> <br />zoned property off Rives Road Extended. At the conclusion of this public <br /> <br />hearing, at which no one registered any objections to petitioner's request, <br /> <br />and in acceptance of the Commission's recommendations thereon, Council <br /> <br />unanimously adopted the following ordinance providing for the vacating and <br /> <br />closing of said streets or portions thereof, subject to certain conditions <br /> <br />and/or alternatives set forth: <br /> <br />WHEREAS, by petition filed April 13, 1971 with Martinsville City Council, <br />Nationwide Homes, Inc., requested the closing and vacating of that <br />portion of Forest Street Extension which extends from its northwest <br />terminus to the southwest corner of Lot No. 49, as shown on petitioner's <br />t1Plat of Surveytl dated February 4, 1971, and the closing and vacating of <br />an unnamed street extending from said Forest Street Extension in a <br />southeasterly direction into petitioner's industrially-zoned property <br />off Rives Road Extended; and <br /> <br />WHEREAS, at Martinsville City Council's regular meeting held May 11, <br />1971, a duly-constituted Board of Viewers reported that, in its opinion, <br />no inconvenience would result to anyone by the closing and vacating of <br />said street portions; and <br /> <br />WHEREAS, also at Martinsville City Council's regular meeting held May 11, <br />1971, at which meeting a duly-advertised public hearing was jointly <br />conducted by said Martinsville City Council and the Martinsville <br />Planning Commission, said Commission recommended that petitioner's <br />request be granted as filed, said Commission suggesting that petitioner <br />file with said Council either a map with the request that the remainder <br />of Forest Street Extension be closed and vacated, providing a "turn- <br />aroundtl at the end of the remainder of Forest Street Extension following <br />the present abandonment; now, therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assembled this eleventh day of May, 1971, that it doth <br />accept the findings and recommendations of both the said Board of Viewers <br />and the said Planning Commission; and <br /> <br />BE IT FURTHER ORDAINED by said Council that the hereinabove street <br />portions are hereby declared vacated, closed and abandoned, subject to <br />the Planning Commission's suggestion hereinbefore cited; and <br />
