<br />358 <br /> <br />TUESDAY <br /> <br />JANUARY 28, 1975 <br /> <br />WHEREAS, by petition dated November 7, 1974 and filed with Martinsville <br />City Council on November 12, 1974, Tully Corporation of Virginia (Sale <br />Knitting Division) requested the closing of Fontaine Street, situated <br />east of Franklin Street and lying within the property boundary lines <br />of petitioner; and <br /> <br />WHEREAS, by report dated December 31, 1974 the Martinsville Planning <br />Commission recommended that petitioner's request be granted and, also, <br />that a fifteen-foot drainage easement, crossing said Fontaine Street <br />to Commonwealth Boulevard, near Franklin Street, be abandoned; and <br /> <br />WHEREAS, at its regular meeting held January 28, 1975, pursuant to <br />Section 3 of Chapter 8 of the Charter of the City of Martinsville, <br />Virginia, the Council of the City of Martinsville conducted a <br />duly-advertised public hearing on said petitioner's request, as <br />approved and amended (as to drainage easement) by the Martinsville <br />Planning Commission; now, therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled January 28, 1975, that it doth hereby <br />accept the report and recommendation of the Martinsville Planning <br />Commission, hereinbefore cited, and does hereby declare and order <br />the abandonment, closing and vacating of that street heretofore <br />identified as Fontaine Street, which lies within and is surrounded <br />by property owned by Tully Corporation of Virginia (Sale Knitting <br />Division), situated north of Commonwealth Boulevard and east of <br />Franklin Street, and does also hereby abandon a fifteen-foot <br />drainage easement crossing Fontaine Street to Commonwealth <br />Boulevard, near Franklin Street, all of which is shown on a map <br />entitled, "Map of Properties for the Tully Corporation of <br />Virginia, Sale Knitting Division", as prepared by J. A. Gustin <br />& Associates under date of October 15, 1974, and revised December <br />17, 1974 to add location of permanent easements; and <br /> <br />BE IT FURTHER ORDAINED by said Council that a copy of this ordinance <br />be filed forthwith with the Clerk of Martinsville Circuit Court, <br />as directive and authorization to mark his records accordingly. <br /> <br />Irr a prepared statement, Councilman Barry A. Greene analyzed various financial <br /> <br />problems currently facing the City, including the anticipated inability of the <br /> <br />1974-75 Boards of Assessors and Equalization to complete their required processes in <br /> <br />time to enable the City to prepare the forthcoming Spring billing of real estate taxes <br /> <br />predicated upon appraisals and/or assessments as of January 1, 1975. Accordingly, <br /> <br />with the verbal assurance from Virginia's Attorney General's office that the City <br /> <br />may use assessed valuations as of July 1, 1974 as the basis for said 1975 Spring <br />
