<br />~88 <br /> <br />TUESDAY <br /> <br />JUNE 25, 1974 <br /> <br />being no objections thereto registered, Council unanimously effected said rezoning <br /> <br />by its adoption of the following ordinance amending the City's Zoning Map: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled June 25, 1974, that the Zoning Map of <br />the City of Martinsville be, and is hereby, amended to effect a <br />"C-3 Commercial" zoning of the following-described properties, <br />previously zoning llR-6 Residentia11l: <br /> <br />(a) The remainder of Lot No. 37 between Harris Court and <br />Kings Row; <br />(b) The remainder of Lot No. 28 east of Kings Row; <br />(c) Lots Nos. 8 through 13, or portions thereof, situated <br />east of properties fronting the east side of Kings <br />Rowand fronting the west side of North Street; <br />(d) Lots Nos. 124 through 132, or portions thereof, <br />fronting the east side of North Street; and <br />(e) The remainder of Lots Nos. 34 through 50 and all <br />of Lots Nos. 4 through 16 and all of Lots Nos. 17 <br />through 33 which lie south of the present llC-3" <br />zoning south of North Memorial Boulevard (Route 220 <br />North) and extend to the rear of lot lines of properties <br />fronting the north side of Fayette Street, bounded <br />on the east side by properties fronting the west side <br />of Beaver Street, by Lots Nos. 1 through 3 fronting <br />the east side of North Street, and the east side of <br />above-mentioned Lots Nos. 124 through 132. <br /> <br />Also, pursuant to duly-advertised public notice, Council conducted a public hearing on a <br /> <br />petition (filed February 26, 1974) by Evelyn H. Stone, Trustee, and as amended by the <br /> <br />Planning Commission, to rezone to llR-9 Residential" all of that 78-acre tract owned by <br /> <br />petitioner and situated on the west side of Rives Road. Initially, petitioner had <br /> <br />requested an llR-6 Residentialll zoning of all except approximately four acres of the <br /> <br />tract but, subsequently, agreed to an "R-91l zoning proposed by the Planning Commission, <br /> <br />still excepting or excluding the four-acre section. Mr. James H. Ford, Attorney at Law <br /> <br />and member of the Planning Commission, briefed Council on the Commission's deliberations <br /> <br />and reasons for recommending that the entire tract be rezoned "R-9", adding a personal <br /> <br />opinion that petitioner could request another rezoning of the four-acre tract when plans <br /> <br />will have been developed for its usage. Upon the written request of Mr. John W. Holmes, <br /> <br />Agent for petitioner, in which request was explained the inability of petitioner's <br /> <br />representatives to be present at this hearing, Council continued this public hearing and its <br /> <br />consideration of this matter to Council's forthcoming July 9th meeting. <br />
