It was explained that due to the topography <br /> <br />it was not feasible for petitioner to connect to the City sewer line which traverses <br /> <br />the Country Club property and that the Health Department had granted permission for <br /> <br />installation of a septic tank facility to serve the single home as proposed. The <br /> <br />matter was referred to the City Planning Commission for a report and recommendation <br /> <br />as to a restrictive covenant as to land use. <br /> <br />,- <br /> <br />Reference was made to a lease agreement which had been entered into in 1952, between <br /> <br />the City and the Union Oil Company, under the terms of which the Company had been <br /> <br />permitted to install underground tanks and/or a pump island as appurtenances to a <br /> <br />service station which had been constructed at that time, on property fronting Memorial <br /> <br />Boulevard just west of the intersection of the Boulevard and Fayette Street. It was <br /> <br />explained that the property which had been under lease was a small parcel the City <br /> <br />had found it necessary to acquire as a portion of right-of-way for Memorial Boulevard, <br /> <br />during its construction. The Company had abandoned the property for use as a service <br /> <br />station and the rights enjoyed under the lease of surplus city property were no <br /> <br />longer required by the Company, whereupon motion was made, seconded, and carried <br /> <br />unanimously that the City agree to cancellation of the lease which had been recorded <br /> <br />in Deed Book 31, at page 135 in the office of the Clerk of the Circuit Court for <br /> <br />the City. <br /> <br />The City Manager traced the history of lots No.9, 10, 11 and 12, fronting on Oak Street, <br /> <br />near its intersection with Graves Street, explaining that each of these lots had been <br /> <br />developed several years ago, by having small residences constructed thereon, but due to <br /> <br />technicalities in the loan which had been secured from the United States Department of <br /> <br />Housing and Urban Development and as a result of which loan technicalities had arisen <br />
