<br />s <br /> <br />TUESDAY <br /> <br />SEPTEMBER 9, 1975 <br /> <br />.,.'--........ <br /> <br />The regular semi-monthly meeting of the Council of the City of Martinsville, <br /> <br />Virginia, with Mayor Harry L. Boaz presiding, was held Tuesday, September 9, 1975, <br /> <br />in the Council Chamber, City Hall, beginning at 7:30 P.M., all members being <br /> <br />present, viz., Harry L. Boaz, Mayor; William D. Hobson, Vice Mayor; <br /> <br />Morton W. Lester; G. S. Fitz-Hugh, Jr.; and Barry A. Greene. <br /> <br />After the invocation, Council approved--as recorded--the minutes of its regular <br /> <br />meeting held August 26, 1975, with an addendum requested by Mr. Douglas K. Frith, <br /> <br />Attorney at Law and Counsel for Nationwide Homes, Inc., with reference to the <br /> <br />testimony presented at Council's said August 26th meeting by Mr. Charles Barnes, <br /> <br />of Wiley & Wilson, pertaining to Nationwide Homes' request for rezoning (to "M-3 <br /> <br />Industrial") of its property on the south side of Rives road at Drewry Road, in <br /> <br />which testimony Mr. Barnes stated in effect that assigned usage of transitional <br /> <br />open space lands, as shown on the 1995 Land-Use Plan recently adopted by the City, <br /> <br />is the prerogative of local regulatory authorities. Council also approved--as <br /> <br />recorded--the minutes of its special meeting held September 2, 1975. <br /> <br />,- <br /> <br />As indicated by Council at the conclusion of its special September 2nd meeting, <br /> <br />Council again gave consideration to Nationwide Homes' request (filed and/or <br /> <br />refiled May 27, 1975) that its property situated on the southeast side of Rives <br /> <br />Road at Drewry Road, consisting of from 1.3-to 1.4 acres, be rezoned to "M-3 <br /> <br />Industrial". As an introduction to the continuing consideration of this rezoning <br /> <br />request, City Manager Noland suggested that City Attorney Worthy brief the Council <br /> <br />on certain aspects of this matter; however, counsel for petitioner, Mr. Douglas K.
