<br />r,,.- ') <br />~_~ :.) t <br /> <br />TUESDAY <br /> <br />OCTOBER 14, 1980 <br /> <br />On Thursday, September 18, 1980, the Planning Commission conducted a <br />duly advertised public hearing concerning the proposed Comprehensive <br />Plan and Land Use Map for Druid Hill-Forest Park area. This public <br />hearing was the conclusion of efforts by Planning Commission, with <br />assistance from the administration, to complete the Comprehensive Plan <br />and Land Use Map, giving consideration to Lanier Farm, Inc., Whittle <br />Family Trust and other property owners whose lands had previously <br />been shown as Permanent Open Space on the preliminary updated Land <br />Use Plan dated March, 1978. Based on these proceedings, Planning <br />Commission voted to recommend to Council that the proposed Comprehensive <br />Plan and Land Use Map be revised to incorparate specific land use changes, <br />as requested by Lanier Farm, Inc., Whittle Family Trust, and others and as <br />shown on the attached map; and, that the Open Space category referred to <br />in the initial Comprehensive Plan update be divided into Open Space-Public <br />and Open Space-Private. (See Appendix A) This recommendation was made <br />with the understanding with the developers that the areas classified as <br />Private Open Space could be considered for change in designation by <br />Council and the Planning Commission as provided by law. <br /> <br />Planning Commission's action was an attempt to answer specific questions <br />raised by Council and to receive all available information in determining <br />projected land usage for these open space areas. <br /> <br />The Planning Commission considered the following information in arriving <br />at it recommendations: <br /> <br />1. An opinion by City Attorney David B. Worthy that the City <br />cannot lawfully deprive any property owner of his or her <br />right to usage of land without proper compensation; and the <br />cpinion ex:pressed at City Council's meeting by the City Attorney, <br />that the City is not involved in any assurances made by developers <br />to property owners who purchased lots in this area. <br /> <br />2. Statements from the Assistant City Manager that meetings between <br />the City Administration, Lanier Farm, Inc., and various property <br />owners had been held in an effort to resolve the matter in question. <br /> <br />3. A statement from the City Administration that these spaces were not <br />needed for the City's Park Improvement Program, and that a number <br />of adjacent property owners had indicated that they would prefer <br />that these spaces not become public property, as this would extend <br />the usage of the property and reduce its purpose and effectiveness. <br /> <br />4. Three areas shown on the proposed Land Use Map were designated <br />Permanent Open Space, but because of documented subdivisions and <br />development plans these areas should have been categorized as <br />residential. These areas are: (a) an area between Lanier Road <br />and Kno1lwood Place; (b) an area along the north side of Mulberry <br />Road between Lanier Road and Knollwood Place; and (c) the area <br />between the end of Lanier Road and Smith River. <br /> <br />'---"-~.._".~"~_..~,.,_._---~'""'_.~._----,.,'_..,"-,~ .._-.-''"-,.-.,.~_~__,~__.".._.h____'." <br />
