<br />,~ (' <br />~,'r"Wi <br /> <br />TUESDAY <br /> <br />APRIL IO, 1979 <br /> <br />- <br /> <br />Upon recommendation of City Manager Noland, Council unanimously authorized the proceeding <br /> <br />with the next phases of the City's contractual agreement with the firm of Scoggins, Sellers <br /> <br />& Associates, of Athens, Georgia, looking towards the eventual installation of a data <br /> <br />processing system for the City and preferably to be compatible with the upgraded system <br /> <br />Henry County will be installing, noting that Henry County desires to become a party to the <br /> <br />City's agreement at this point and to pay for its share of the ensuing cost of said next <br /> <br />- <br /> <br />phases. <br /> <br />Pursuant to Section 2.1-344 of the CODE OF VIRGINIA (1950, and as amended), and by a <br /> <br />recorded and unanimous vote, Council convened into an Executive Session for the purpose of <br /> <br />being briefed by City Attorney Worthy on a legal matter involving the current litigation <br /> <br />between the County of Henry and the City over "water rights" within Henry County. Upon <br /> <br />reconvening into regular session, Council unanimously approved a proposed agreement <br /> <br />(between the City and the County of Henry and its Public Service Authority) and authorized <br /> <br />the execution thereof by City Manager Noland, for presentation to the County of Henry and <br /> <br />its Public Service Authority for their consideration and execution, if they so agree, <br /> <br />under which agreement the City of Martinsville will not construct any new water distribution <br /> <br />mains or enlarge and/or extend its existing water distribution mains without first obtaining <br /> <br />the consent of Henry County and its Public Service Authority, whereas Henry County and its <br /> <br />Public Service Authority would agree to recognize the City's right to operate its existing <br /> <br />water supply system in Henry County (without consent) and to recognize the City's right <br /> <br />to allow new connections to its existing water distribution mains, provided that such <br /> <br />connections shall be to buildings or other improvements located upon lots or parcels of <br /> <br />land abutting said mains or upon a street or other public way containing existing <br /> <br />distribution water mains of the City, except that the City will not permit any new <br />
