RESOLUTION A RESOLUTION ESTABLISHING CITY COUNCIL POLICY REGARDING REQUESTS FOR TAX EXEMPTION BY NOT -FOR-PROFIT ORGANIZATIONS WHEREAS, it is the goal of the City of Martinsville to provide an equitable property taxation system for the owners of real and personal property in the City; and WHEREAS, not-for-profit organizations apply to the City of Martinsville from time to time seeking exemptions from real or personal property taxes as provided by law; and WHEREAS, the City Council of the City of Martinsville deems it necessary to establish a policy regarding future tax exemption requests from not-for-profit organizations; WHEREAS, fiscal constraints, both current and projected, facing the City of Martinsville dictate a more cautious policy concerning the consideration of tax-exempt requests by not-for-profit organizations, and WHEREAS, a Constitutional amendment referendum and subsequent enacting legislation has fundamentally changed the process for seeking tax exemptions, and WHEREAS, the City Council finds it appropriate to place a moratorium on the consideration of such tax-exempt requests until the city's financial position is clarified; now, therefore BE IT RESOLVED that: 1. It is the policy of the City of Martinsville that requests for tax exemption are not generally endorsed or encouraged; 2. A moratorium on the consideration of tax exempt requests by not-for-profit organizations will be in effect immediately and continue in effect until further notice; 3. Organizations currently enjoying tax exempt status in the City of Martinsville will maintain such status; 4. Organizations who enjoy tax-exempt status by virtue of statutory classification (i.e., churches) are unaffected by this moratorium. ******* Attest: Johnathan B. Phillips, Clerk of Council Date Adopted
