<br />TUESDAY <br /> <br />AUGUST 24, 1982 <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, <br />Virginia, in regular meeting assembled, that Chapter 8 of the <br />Code of the City of Martinsville (1971, and as amended) con- <br />cerning the regulation of garbage, refuse and weeds be, and <br />the same is, hereby, revised in its entirety to read as follows: <br /> <br />ARTICLE I <br />TRASH AND WEEDS <br /> <br />Sec. 8-1 <br /> <br />Dumping trash on or along public streets or sidewalks. <br /> <br />-- <br /> <br />a. Any person shall be guilty of a Class 1 misdemeanor <br />who shall dump, throw, drop, deposit,or dispose of <br />any trash, garbage, refuse, dead animal carcass, <br />rubbish, glass, ashes, or litter on any public street, <br />sidewalk, right-of-way, property adjacent to such <br />street or right-of-way or on private property without <br />the consent of the owner. <br /> <br />b. When a violation of the provisions of this section has <br />been observed by any person, and the matter dumped, <br />thrown, dropped, deposited, or disposed of on the <br />street, sidewalk, right-of-way, property adjacent to <br />such street or right-of-way, or property has been <br />ejected from a motor vehicle, the owner or operator <br />of such motor vehicle shall be presumed to be the <br />person ejecting such trash, garbage, refuse, dead <br />animal carcass, rubbish, glass, ashes, or litter. Such <br />presumption may be rebutted by competent evidence. <br /> <br />Sec. 8-2 <br /> <br />Removal of grass, weeds, and vegetative growth from <br />vacant lots. <br /> <br />a. It shall be the duty of the owner of any vacant lot <br />or parcel of land in the city to cut or cause to be <br />cut all grass, weeds, or like vegetative growth which <br />exceeds a height of three feet above the ground and <br />which is deemed by the Director of Public Works to <br />create a potential threat to public health or safety. <br /> <br />b. Should the owner of any such property fail or refuse <br />to abide by this requirement, then the Director of <br />Public Works shall give a l"Titten notice to such owner <br />requiring the owner to cut or have cut such grass, <br />weeds, or vegetative growth within fifteen (15) days <br />after the date of the notice. <br /> <br />c. Such notice shall be given to the owner by personally <br />serving a copy of such notice on the owner or his <br />
