<br />~9() <br /> <br />TUESDAY <br /> <br />DECEMBER 18, 1984 <br /> <br />Comprehensive Plan of the recently-presented capital expenditures program for the <br /> <br />City School System. <br /> <br />Referring to published notices of public hearings conducted by City agencies and, <br /> <br />particularly, to a recent notice of public hearing to be conducted by the Planning <br /> <br />Commission on December 20, 1984, on changes in the City's Zoning Ordinance the <br /> <br />Planning Commission will probably recommend to City Council for adoption or enact- <br /> <br />ment, Mayor Cole posed the question as to whether such notices--although in com- <br /> <br />pliance with statutory regulations--constitute sufficient and adequate notice to <br /> <br />the public and/or whether Council should direct that such notices be published in <br /> <br />display-type form and/or whether "parallel" publication of such notices (at City <br /> <br />cost) should be provided through locai radio stations. In raising these questions, <br /> <br />Mayor Cole observed that, for one reason or. another and on many occasions, citizens <br /> <br />do not appear before the Planning Commission or before other agencies on matters of <br /> <br />importance to the citizens, and their concerns become first known only when City <br /> <br />Council conducts its required public hearings on these same matters. Procedures <br /> <br />required of the Planning Commission in publicizing public hearings as well as <br /> <br />notifying adjacent property owners were then described; furthermore, City Attorney <br /> <br />Worthy questioned the legality of expending public funds for advertising public <br /> <br />hearings over and above that statutorily required. <br /> <br />In accordance with the requirements of Section 2.1-344(a)(6) of the CODE OF VIRGINIA <br /> <br /> <br />(1950, and as amended) and pursuant to motion, duly seconded and unanimously carried <br /> <br /> <br />(by a recorded vote), Council convened into an Executive Session for the purpose of <br /> <br />discussing certain legal matters within Council's jurisdiction. At the conclusion of <br /> <br />this Executive Session, Council reconvened into open session but took no action on <br /> <br />these legal matters. <br />
