<br />42 <br /> <br />TUESDAY <br /> <br />SEPTEMBER 25, 1984 <br /> <br />Pursuant to Council's action at its regular meeting held September 11, 1984, regarding <br /> <br />a proposed amendment to Section 22-62 of the City Code and the including therein of <br /> <br />appellate procedures, City Attorney Worthy presented (for reintroduction) said amend- <br /> <br />ment to Section 22-62 as well as (for introduction) an amendment to Section 22-69 and <br /> <br />a new section identified as 22-70, by which applicants for taxi-cab driver permits--if <br /> <br />denied such permits under terms of the City Code--would have the right of appeals to <br /> <br />City Council, it being pointed out that the City can not provide for appeals to the <br /> <br />judiciary under current State statutes. After offering his motion (which was not <br /> <br />seconded) that the three amending ordinances be accepted for introduction, Councilman <br /> <br />Groden concurred with Vice-Mayor Severt's objection to the proposed Section 22-70, <br /> <br />which would place the appeals burden on City Council, and, subsequently, Councilman <br /> <br />Groden withdrew his motion. On motion by Councilman Williams, seconded by Council- <br /> <br />man Groden, Council "tabled" this matter (Le., the three proposed amendments) for <br /> <br />further study, particularly as to some alternate method of providing appellate pro- <br /> <br />cedures, the vote being three-to-one to "table" (Mayor Cole voting against the motion). <br /> <br />Messrs. Richard Harris (of 1000 West Fayette Street) and Jesse B. Travis (of 401 Fifth <br /> <br />Street), along with a Mr. Dickson (or "Dixon" or "Dixson"), appeared before Council and <br /> <br />cited certain conditions along Fayette Street, from North Moss Street and/or Market <br /> <br />Street westward to Pine Hall Road, which need improving (such as surface conditions <br /> <br />and deterioration) and, also, cited hazards caused by tractor-trailer traffic which <br /> <br />may be illegally using this street. Councilman Williams, along with Assistant City <br /> <br />Manager-Public Works Director George W. Brown, pointed out that certain street improve- <br /> <br />ments are scheduled for the near future whereas Mayor Cole suggested that the safety <br /> <br />hazards be brought to the attention of the City's Transportation Safety Commission. <br /> <br />In accordance with sub-sections (1), (2), and (6) of Section 2-1-344(a) of the CODE OF <br /> <br />VIRGINIA (1950, and as amended), and upon motion, duly seconded and unanimously carried <br />
