<br />22 <br /> <br />FRIDAY, FEBRUARY 28, 1986 <br /> <br />Groden for bringing this matter (i.e., "grand fathering" of rights) <br />to the Council's attention. <br /> <br />3. Mr. H. A. Jessie, Owner, Shumate & Jessie Furniture Company, 30 <br />Franklin Street. <br /> <br />4. Mr. Robert L. Canupp, Jr., President-Treasurer, Martinsville <br />Office Supply, Inc., 33 West Main Street, and a member of the <br />former CBD Commission, a member of the Downtown Business Associ- <br />ation, and member-chairman of the Commercial Development Commis- <br />sion, who expressed support of requiring all signs to be in con- <br />formity as well as suggested that this matter be referred to the <br />CDC that it might attempt to develop ways and means of obtaining <br />uniformity, a goal the "grand fathering" proviso will defeat. Mr. <br />Canupp cited, too, his perceived lack of communication on the <br />City's part during the course of events stemming from the 1980 <br />sign ordinance amendments. <br /> <br />5. Mr. Donald W. Hinton, Assistant Vice-President, Charter Federal <br />Savings & Loan, 755 East Church Street. <br /> <br />Also present but not speaking to this issue were Mr. Rayford B. Smith, Architect, and <br /> <br />Mr. Thomas W. Patterson, President & General Manager of WHEE Radio, 40 Franklin Street. <br /> <br />An ensuing discussion among members of Council and with City Manager Brown, City Attor- <br /> <br />ney Worthy, and City Building Official James W. Jones, Jr., centered around the possible <br /> <br />effect of, and/or ways and means of, "reinstating" vested rights retroactively which <br /> <br />City Attorney Worthy noted is a legal obligation incumbent upon the City, and which in <br /> <br />instances will require the City to compensate certain business firms for some expenses <br /> <br />incurred in bringing their signs into conformity with the City's 1980 regulations when, <br /> <br />had they been afforded their vested rights by "grandfathering", such expenses might <br /> <br />otherwise not have been incurred. <br /> <br />Mayor Cole, after expressing thanks to Councilman Groden for bringing this matter to <br /> <br />Council's attention (as he did during Council's February 25th meeting), declared this <br /> <br />special meeting adjourned. <br /> <br /> <br />Clerk of Council <br />
