<br />"... , <br /> <br />21~ <br /> <br />FRIDAY, FEBRUARY 28, 1986 <br /> <br />- <br /> <br />all signs that were in existence when this ordinance was enacted in 1980, provided <br /> <br />that such signs have not been enlarged, extended, reconstructed, or structurally <br /> <br />altered." <br /> <br />City Manager Brown, pursuant to Council's request from its regular meeting held Febru- <br /> <br />ary 25, 1986, presented the following written review entitled, "Nonconforming Signs", <br /> <br />which describes certain chronological actions dealing with enactments of amendments <br /> <br />to the City's "sign ordinance" as well as with enforcement thereof and the current <br /> <br />status: <br /> <br />In April, 1980, fairly extensive amendments were made in the City's Zoning <br />Ordinance. In addition, Subsection X.G was included in these amendments <br />which read as follows: <br /> <br />"Every sign erected before the adoption of this ordinance and <br />which is not in conformance with the requirements of this ordi- <br />nance shall comply with this ordinance when in any calendar <br />year, required maintenance, moving or replacement cost exceeds <br />50% of its original cost or value, whichever is applicable. All <br />such signs shall be brought into compliance, in all respects to <br />the provisions of this ordinance within five (5) years from the <br />effective date of this ordinance. Failure to comply shall con- <br />stitute a violation of this ordinance unless the sign shall <br />have been removed prior to the expiration of the five year <br />period." <br /> <br />On Tuesday, August 27, 1985, Council, acting on recommendations of the <br />Planning Commission and City Administration, amended Section X Signs, Sub- <br />section D of the Zoning Ordinance reducing the setback of signs in the P-l, <br />P-2 and RP-l Districts from thirty (30) feet or building setback line <br />(whichever is the lesser distance from the street) to fifteen feet in an <br />effort to assist the property owners and business operators in these dis- <br />tricts, particularly along Starling Avenue. <br /> <br />This same ordinance also deleted Subsection X.G as described above which <br />gave all owners of signs in all districts five (5) years to comply with the <br />sign ordinance. <br /> <br />The deletion meant, according to the ordinance, that all signs in all dis- <br />tricts that were not in compliance with the ordinance requirements as of <br />April 5, 1985, were classified as illegal signs. We, therefore, advised <br />Council that we would proceed with enforcement of the ordinance but that <br />this would be attempted in a systematic manner and that we would give busi- <br />ness owners and operators a reasonable time to comply--ninety (90) days. <br /> <br />.. -..-...'---_____M_______.__..".___..._...._ <br />
