<br />".." <br />~h <br /> <br />August 29, 2006 <br /> <br />those business matters identified in the motion convening the Closed Session <br /> <br />were heard, discussed, or considered during said Session. Upon returning to <br /> <br />Open Session, Council took the following action: <br /> <br />Consultation with legal counsel and briefings by staff members, <br /> <br />attorneys or consultants pertaining to specific legal matters requiring the <br /> <br />provision of legal advice by such counsel, as authorized by Subsection 7. <br /> <br />City Attorney Eric Monday read an excerpt from the J. Frank Wilson <br /> <br />Park deed and requested Council authority to ask for declaratory judgment to <br /> <br />void the racially restrictive clause included in the deed and to clarify the <br /> <br />language "or for any other municipal purpose or enterprise". Council Member <br /> <br />Ferrill moved that the City Attorney be authorized to proceed as requested; the <br /> <br />motion was duly seconded and carried by the following vote, with all members <br /> <br />voting: Vote 5-0. Yeas (5) - Reynolds, Clark, Anderson, Ferrill, Lawson. Nays <br /> <br />(0). <br /> <br />Vice Mayor Clark made a motion that the City not appeal the Judge's <br /> <br />decision regarding the cable purchase; the motion was duly seconded and <br /> <br />carried by the following vote, with all members voting: Vote 5-0. Yeas (5) - <br /> <br />Reynolds, Clark, Anderson, Ferrill, Lawson. Nays (0). <br /> <br />Section 15.2-2907(D) - negotiation of city-to-town reverSIOn Issues <br /> <br />subject to review by Commission on Local Government. No action taken. <br />
