August 23, 2005 Council next considered the need to adopt an Ordinance, on second reading, on a request by the Lester Group, Inc. to abandon a portion of property known on Tax Map 20 of the City of Martinsville as Allen Street. Council Member Ferrill moved to approve the following Ordinance, on second reading; the motion was duly seconded and carried by the following roll call vote, all members voting: Vote: 5-0. Yeas: (5) Cobbe, Reynolds, Roop, Ferrill, Clark. Nays: (0) None. AN ORDINANCE ABANDONING ALLEY SPACE CITY OF MARTINSVILLE BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in regular session assembled July 26, 2005, that in order to assure compliance with Section 915.2-2006 of the Code of Virginia, it is stated that the public purpose for which this Ordinance is initiated is to fulfill the requirements of public necessity, convenience, general welfare and good zoning practice, that the road space, as described below, be--and is hereby declared--vacated and abandoned, in favor of The Lester Group -- subject to payment of the accessed value of $1,500.00, and the filing of an appropriate map with-and the approval by-the City's Community Development Director/or the City's Public Works Director, showing the area hereby declared vacated and abandoned by City Council on this date, which map, when and as approved, shall be duly recorded in the office of the Clerk of MartinsviIle City Circuit Court: The northern section of an old street space 40-feet wide, beginning at the property line between Lots 12 and 14 and extending for a distance of approximately 300-feet, located off Smith Street and known on the Tax Map 20 of the City of MartinsviIle as Allen Street. Council next considered the need to consider adoption of Ordinance 2005- 7 , on second reading, on a request by the Planning Commission to amend various sections of the Zoning Ordinance and Land Subdivision Ordinance.
