<br />City of Martinsville, Virginia <br /> <br />Ordinance No. 2005-6 <br /> <br />BE IT ORDAINED by the Council of the City of MartinsviIle, Virginia, in Regular Session held <br />on June 13, 2005, Sections 2-25 and 2-26 of the Code of the City of Martinsville currently <br />reserved, be, and hereby are, added to read as follows: <br /> <br />Sec. 2-25. Adoption of rules and regulations. <br /> <br />(a) The director of finance shall have the power to make reasonable rules and <br />regulations not inconsistent with this chapter or other provisions of law or applicable ordinances, <br />as deemed necessary to ensure the proper management, conduct, operation and control of the <br />wastewater, water, and electric utilities. The rules and regulations shall conform to reasonable <br />standards adopted or approved for the management, conduct, operations and control of <br />wastewater, water, and electric utilities and may be altered or amended from time to time by the <br />director of finance when the director of finance deems it necessary to do so for the proper <br />management, conduct, operation and control of the utilities. No rule or regulation made by the <br />director of finance pursuant to this section or any alteration or amendment thereof shall become <br />effective or have the force and effect of law unless the director of finance shall: <br /> <br />(1) Make such rule or regulation or any alteration or amendment thereof in <br />convenient form, available for public inspection in the director of finance's office <br />at least ten days before such rule or regulation or alteration or amendment thereof <br />is to become effective. <br /> <br />(2) File a true copy of such rule or regulation or alteration or amendment thereof <br />adopted by the director of finance after such public hearing with the city clerk. <br /> <br />(b) It shall be unlawful for any person to fail, refuse or neglect to comply with or <br />violate any rule or regulation made, adopted and filed pursuant to this section or any alteration or <br />amendment thereof. <br /> <br />2-26 Good Neighbor Fund Utility Assistance Program. <br /> <br />The director of finance may establish the Good Neighbor Fund Utility Assistance Program <br />whereby the department of public utilities will accept tax-deductible donations from its <br />customers and engage a nonprofit agency to disburse such funds to individuals within the <br />department of public utilities' service territory who need financial assistance paying their utility <br />bills issued by the city. Pursuant to section 2-25, the director of finance may also establish <br />appropriate rules and regulations regarding the eligibility criteria for the award of financial <br />assistance and the accounting, audit and control measures to monitor the disbursement of funds <br />by the nonprofit agency. <br />
