Department: Human Resources Date: 10-12-04 City Council Agenda Sunanm'y Agenda Item: Discussion of items relating to residency requirements for department heads: A. Approval, on second reading, of Ordinance No. 2004-17 mending Section 2-3 of Chapter 2 Administration of the City Code relating to residency requirements for department heads. Sturllnary: The Code of Virginia allows, but does not require, Cities to impose residency requirements upon certain employees: Further, new information collected by 'the Human Resources Office, indicates that 16 of the 32 iurisdictions contacted have specific residency requirements For example, when the condition does not apply to all department directors, the prerequisite may apply to the Chief of Police, Public Works Director, and/or the Fire Chief. In some jurisdictions, the City Manager has the authority to determine where the requirement will be mandatory. Most policies give newly hired employees a window of time to comply ~vith the condition of employment, generally 90 days to up to 12 months. The Ordinance reflects those positions that would be subject to residency requirements, those exempt from the policy at the time of adoption, and the timeframe for new or promoted employees to reside within the City. Amendments that were made at your September 28th meeting are indicated on the attached. Recommended Council Action: Place on next agenda.
