Within thirty (30) days after the date that the board first reviews the application, <br />the board shall decide whether or not to issue a certificate of appropriateness. <br /> <br />In any event, if no decision has been made by the architectural review board <br />within sixty (60) days after the secretary has received the application, and no <br />mutual agreement between the applicant and the Architectural Review Board has <br />been made for the extension of this time period, the secretary of the board shall <br />submit the application to the Clerk of Council, and Council shall review the <br />application, in the same manner as if a decision of the Architectural Review <br />Board had been appealed. <br /> <br />M. Notification of Issuance of Certificate of Appropriateness <br /> <br />If the Architectural Review Board approves an application, it shall record its <br />reasons therefore in its minutes, issue a certificate of appropriateness signed by <br />the secretary of the board, attach the certificate to the application, and transfer the <br />application, with attached certificate, to the Zoning Administrator and the <br />Building Official. Upon receipt thereof, if applicable, the Building Official shall <br />issue a building permit in the usual manner. <br /> <br />If the Architectural Review Board disapproves an application, it shall state its <br />reasons for doing so and shall transmit a record of the reasons to the applicant, the <br />zoning administrator and the building official. At any time after disapproval, the <br />applicant may resubmit an application, with or without amendments, which shall <br />be processed in the same manner as set forth in this section. <br /> <br />N. Zoning Administrator and Building Official to Enforce Provisions of this Section <br /> <br />The Zoning Administrator and the Building Official shall enforce the provisions <br />of this section. <br /> <br />O. Appeals from the Board to City Council <br /> <br />Whenever the architectural review board shall, in a decision, deny an applicant a <br />certificate of appropriateness, the applicant shall have the right to appeal to and be <br />heard before City Council, on or before thirty (30) days after the decision of the <br />board, a notice, in writing, of his intention to appeal. Upon receipt of such notice, <br />the Clerk of Council shall forthwith notify the City Manager, who shall schedule a <br />public hearing before city council at a time not to exceed thirty (30) days after <br />receipt by the clerk of such notice. <br /> <br />Opponents to the granting of certificates of appropriateness by the Architectural <br />Review Board, shall have the right to appeal to and be heard before the City <br />Council, provided there is filed with the Clerk of Council, on or before thirty (30) <br /> <br /> <br />
