Enclosure #... o~, <br /> <br />City of Martinsville, Virginia <br />Ordinance No. 2004-8 <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in regular session held <br />on May 25, 2004, that Article III. Public Dances of Chapter 4 of the City Code be amended to <br />read as follows: <br /> <br />ARTICLE III. PUBLIC DANCES <br /> <br />Sec. 4-30. Permit--Required; application; fee <br /> <br /> (a) It shall be unlawful for any person to maintain, conduct or operate any public dance in the <br />city, without first obtaining from the city manager a permit, in writing, permitting the same to be <br />held. Any person desiring to hold a public dance shall make application to the city manager at <br />Ieast fifteen (15) working days in advance of the time the same is to be held; provided, however, <br />that an annual permit may be issued for dances held and conducted in regularly established and <br />licensed places used principally for dances. <br /> <br /> (b) Application for a permit required by this section shall be made in writing on forms to be <br />provided by the office of the city manager. The nonmfundable fee for such application shall be <br />Fifty Dollars ($50), payable to the City Treasurer and collected contemporaneously with the <br />application. <br /> <br />Sec. 4-31. Same--Issuance or refusal; revocation. <br /> <br /> (a) The city manager may issue or refuse to issue a permit applied for under section 4-30 <br />within ten (10) working days after inspection process is completed, or he may cancel or revoke <br />any such permit after it has been issued, if he shall learn that the same was procured by fraud or <br />false representation or that the applicant has failed to comply with the provisions of this article or <br />the terms of the permit or has violated any ordinance of the city or any laws of the <br />commonwealth in connection with the application for or the use of the permit, or for any other <br />reason which, in the opinion of the city manager, will be detrimental to the public peace, health <br />or welfare. <br /> <br />Sec. 4-32. Special permit for operation between certain hours; Sunday operation. <br /> <br /> (a) It shall be unlawful for any person to maintain, conduct or operate any public dance <br />between the hours of 1:00 a.m. and 7:00 p.m., without having first obtained a special permit from <br /> <br /> <br />
