February 24, 2004 <br /> <br />impediment of future development. Mayor Teague declared the public hearing closed. <br /> <br />Vice Mayor Roop moved to adopt the following Ordinance on emergency basis; the <br /> <br />motion was duly seconded and carried by the following roll call vote, with all members <br /> <br />present voting: Vote 5 - 0; Yeas (5) - Cobbe, Dallas, Ferrill, Roop, Teague; Nays (0) - <br /> <br />None: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, <br />Virginia, in regular session assembled February 24, 2004, that in <br />order to assure compliance with Section §15.2-2006 of the Code of <br />Virginia, it is stated that the public purpose for which this Ordinance <br />is initiated is to fulfill the requirements of public necessity, <br />convenience, general welfare and good zoning practice, that the <br />alleyway space, as described below, be--and is hereby declared-- <br />vacated and abandoned, in favor of J & R Management, Inc., and <br />that the City policy requiring payment for the assessed value of said <br />property has been waived-- subject to the filing of an appropriate <br />map with--and the approval by--the City's Planning, Zoning and <br />Housing Manager and/or the City's Public Works Director, showing <br />the area hereby declared vacated and abandoned by City Council <br />on this date, which map, when and as approved, shall be duly <br />recorded in the office of the Clerk of Martinsville City Circuit Court: <br /> <br />An alley space 12-feet wide and approximately 280-feet in length <br />located southeast across the property at 762 E. Church Street, said <br />alley adjoining parcels 35(5)1, 2A, 2B, 3, 4, 4A, 5 and 6, as shown <br />on the Tax Map of the City of Martinsville. <br /> <br />BE IT FURTHER ORDAINED by said Council that, an emergency <br />existing, this ordinance shall be in force immediately upon adoption. <br /> <br />Council considered business from the floor. Donna Rivera, of 110-A Gravely <br /> <br />Street, requested a traffic light study be performed for the intersection of Moss and <br /> <br />Market Streets and walk signals be installed at all Market Street intersections; the issue <br /> <br />was referred to the Transportation Safety Commission. Sammy Wright, of Church <br /> <br />Street Auto, 926 East Church Street, stated that more interest should be placed in the <br /> <br />East Church Street area. Mr. Bartlett stated that Academy Place will need to be <br /> <br /> <br />
