Enclosure Cf <br /> <br />January30,2004 <br /> <br />Martinsville <br />A CITY WITHOUT L/MITS <br /> <br />The Honorable Mayor and City Counci! <br />City of Martinsville <br />Martinsville, Virginia <br /> <br />Dear Council Members: <br /> <br />The Planning Commission, at its regular meeting on January 22, 2004, conducted a duly advertised <br />Public Hearing on a request by J & R Management, Inc., to abandon an alleyway, 12-feet in width and <br />280-feet in length, located on the property at 762 E. Church Street. .. <br /> <br />At the Public Heating it was noted survey maps indicate this "paper" alley passes through the existing <br />CVS Pharmacy building and has no value to the use of this property. All the land surrounding this <br />alleyway is in the ownership of the petitioners. There was no response from the public regarding this <br />petition. According to City Assessors the property value of this land is $4,267.50. This abandonment <br />is requested to eliminate impediment of future development. <br /> <br />In order to assure compliance with Virginia Code 15.2-2200, it is stated that the public purpose for <br />which these Resolutions are initiated is to fulfill the requirements of public necessity, convenience, and <br />general welfare. <br /> <br />Following discussion of the matter, the Planning Commission voted unanimously (3-0 with one <br />abstention) to recommend to City Council the proposed abandonment be granted according to City <br />policy. <br /> <br />The Planning Commission respectfully submits the above recommendation for Council's further <br />consideration. <br /> <br />Sincerely, <br /> <br />Jean P.
