Letter of Intent <br />To Participate in the Preparation of a Regional Ali-Hazards Mitigation Plan <br /> <br />Enclosure <br /> <br />The Disaster Mitigation Act of 2000 (DMA2K), amending the Robert T. Stafford Disaster Relief and Emergency Assistance <br />Act (42 U.S.C. 5121 et seq.), requires the development, approval, adoption, and implementation of a local or regional all-hazard mitigation plan by <br />the political subdivisions of the Commonwealth of Virginia as defined by the Code of Virginia <br />(Title 44 Section 146.16(8) in order to maintain eligibility for federal pre- and post-disaster mitigation grants after November 1, 2004. <br /> <br />By signing this Letter of Intent, the City of Martinsville commits to participating in the development of a regional All-hazard Mitigation Plan by West <br />Piedmont Planning District Commission or by a consultant for this regional planning agency in accordance with the requirements of the DMA2K <br />described by the Cod of Federal Regulations Title 44 Part 201.6 and Commonwealth of Virginia, Department of Emergency Management guidance <br />on this process. <br /> <br />The City of Martinsville entem into this agreement voluntarily with the understanding that this locality will be responsible for fully participating in this <br />plan development process, whether it is performed by the regional planning agency or by a consultant. <br /> <br />The City of Martinsville also agrees to submit the completed mitigation plan to its local governing body for formal adoption at the conclusion of the <br />planning process. Local adoption of the plan will be required in accordance with the Code of Virginia (Sections 15.2-2226 and 15.2-2231) after it has <br />been reviewed by the Virginia Department of Emergency Management and the Federal Emergency Management Agency (FEMA), and pre-approved <br />by FEMA pending local adoption. <br /> <br />Locality Name: <br /> <br />City of Martinsvige <br /> <br />Locality Administrator: <br /> <br />W.W. However, it will seek <br />funding to develop its own mitigation plan in accordance with the regulations and guidance cited above. This locality understands that <br />federal and/or state funding may not be available at this time to support the development of such a plan, and that failure to complete <br />such a plan by November 1, 2004 may result in the unavailability of federal and/or state hazard mitigation funding through the Hazard <br />Mitigation Grant Program (HMGP; 44 CFR Part 206) or the Pre-Disaster Mitigation grant program {PDM; Federal Register <br />68(129):40284-40289; July 7, 2003). <br /> <br />The City of Martinsville WILL NOT participate in the development of a regional All-hazard Mitigation Plan, nor will it seek to develop its <br />own mitigation plan as described by the regulations and guidance cited above.
