City of Martinsville, Virginia <br /> <br /> AMENDMENT TO <br /> ORDINANCE NO 2003-12 <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular session held on September 9, 2003 that Section 15.2-27, paragraph (4) <br />Alternatives, be amended to read as follows: <br /> <br />Section 15.5-27. Procedure to abate. <br /> <br />(4) <br /> <br />Alternatives. Any person notified under Subsection (1) of this <br />section shall exercise one of the following alternatives within 10 <br />days from the time notice was received: <br /> <br />a. Abate the nuisance at the expense of the person so notified; <br /> <br />Furnish the Building Official with written consent for the City to <br />abate the nuisance with the costs of such abatement to be <br />assessed to the person consenting; or <br /> <br />c. Request an appeal to the Board of Appeals. <br /> <br />Reconsideration hearing before the Board of Appeals. <br />Whenever an appeal is taken under subsection (4)c., the Board <br />of Appeals shall give notice to all interested parties, including <br />the owner and occupant of the property, of the date, time and <br />place of a public hearing to be held to determine whether a <br />nuisance does exist. The public hearing shall occur no later than <br />seven business days after the appeal is requested. All persons <br />notified shall be given an opportunity to present evidence and <br />make arguments to the Board of Appeals and be represented by <br />an attorney. If the Board of Appeals determines that a nuisance <br />does exist, the Board of Appeals shall issue to the Building <br />Official an order to abate the nuisance in any reasonable <br />manner and assess the costs against the property. The order <br />shall contain written findings of fact and a copy of the order <br />shall be given to all interested parties. However, the Building <br />Official shall have the power to summarily abate, in any <br />reasonable manner, any nuisance, which constitutes an <br />immediate danger to the health, safety and welfare of the <br /> <br /> <br />
